2 RESOLUTION SETTING THE 1995 ALLOCATION POOL

5 WHEREAS, the City Council has adopted a growth management system by Ordinance
6 1716 N.C.S. (Chapter 17.26 of the Petaluma Municipal Code) establishing the procedure
7 for setting the allocation pool on a yearly basis; and

9 WHEREAS, interested developers have filed Notice of Intent to Develop forms in
10 accordance with the provisions of Chapter 17.26 and these, in combination with other
11 allocation obligations created and anticipated by the action of the City Council, comprise
12 the total number of allocation requests for 1995; and
13
14 WHEREAS, the setting of allocations must be done in conformance with General Plan
15 .policy that permits an annual average of 500 allocations, no more than 1,000 allocations in
16 any year and no more than 1,500 allocations over three consecutive years; and
17
18 WHEREAS, total requests for 1995 allocations equals 258 units; and
19
20 WHEREAS, there is no compelling reason to set the allocation pool higher than the
21 number of requested units this year; and
22
23 WHEREAS, setting the allocation pool lower than 500 units leaves open the possibility of a
24 secondary allocation pool in May; and
25
26 WHEREAS, the City Council finds the setting of allocations is not a project pursuant to
27 Section 1578 of the California Environmental Quality Act and, therefore, no environmental
28 action is necessary at this time; and

30 WHEREAS, the City Council met on April 18, 1994, and discussed the setting of the pool
31 for 1995 allotments and considered future demands;

33 NOW, THEREFORE, BE IT RESOLVED that the City Council sets the 1995 allocation
34 pool at 258 units.

36 BE IT FURTHER RESOLVED that the City Council makes the following findings in
37 support of its setting the 1995 allocations pool:

Findin s:
1. The number of available 1995 allotments is consistent with the provisions of the
Residential Growth Management System Ordinance (Chapter 17.26 of the
Petaluma Municipal Code) and the applicable policies of the 1987-2005 Petaluma
General Plan.
2. The City Council need not consider the 1995 Development Objectives in
determining the 1995 allocation pool because the number of requested allocations
was less than 500.
3. The decision to set the 1995 allocation pool at 258 is not detrimental to the public
health, safety or welfare because the City Council has considered the 1995
allocation pool in the context of overall City-wide growth rates, adequacy of public
facilities, and the timing of development, and this pool satisfies all applicants.
