HomeMy WebLinkAboutResolution 2022-012 N.C.S. 01/24/2022 DocuSign Envelope ID:ECB4EF99-1 D874C8E-9EK-1818F64B4C04 Resolution No. 2022-012 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING THE AWARD OF CONTRACT FOR THE TRAFFIC SIGNAL TIMING IMPROVEMENT PROJECT C16102250 TO DC ELECTRIC GROUP,INC. WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents and solicited bids for Traffic Signal Timing Improvement Project C16102250 (Project); and WHEREAS, the project was bid on November 25, 2021, and five (5)bids were received and opened on December 9, 2021, in accordance with applicable law; and WHEREAS, the lowest responsible bid for the Project was submitted by DC Electric Group, Inc., from Cotati CA, for$128,240; and WHEREAS, DC Electric Group, Inc., satisfies the bidding requirements for the Project; and WHEREAS, DC Electric Group, Inc., possesses a valid California Contractor's License, Class C-10, #949934, that covers the work; and WHEREAS, the time to protest the lowest responsible bidder has lapsed; and WHEREAS, the Traffic Signal Timing Improvement Project C16102250 is categorically exempt pursuant to California Environmental Quality Act ("CEQA") and Title 14, the California Code of Regulations ("CEQA Guidelines"), Section 15301,because the project consists of repair and maintenance to existing traffic signal system. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares that the above recitals are true and correct and are incorporated into the resolution as findings of the Petaluma City Council. 2. Finds that this project is categorically exempt from California Environmental Quality Act("CEQA") requirements pursuant to Article 19, Section 15301(c), of Title 14 of the California Code of Regulations ("CEQA Guidelines"), because the project consists of the repair and maintenance. Accordingly, there is negligible or no expansion of use beyond what currently exists and there are no cumulative impacts, unusual circumstances, or other factors that would make the exemption inapplicable pursuant to CEQA Guidelines section 15300.2. 3. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162, and other applicable law, waives any and all non-conformance in the bid of DC Electric Group, Inc., for the Traffic Signal Timing Improvement Project C16102250 and finds the bid of$128,240 to be the lowest, responsive bid and further finds that DC Electric Group, Inc., is the lowest responsible bidder. 4. Awards the contract for the Traffic Signal Timing Improvement Project C16102250 to DC Electric Group, Inc., in the amount of$128,240, the amount of the lowest responsive bid, conditioned on DC Electric Group, Inc., timely executing the project contract, and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 5. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by DC Electric Group Inc., of the signed project contract and all other required document, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 7. Authorizes staff to prepare a year-end budget adjustment for the CIP project as outlined in the Financial Impact Section. Under the power and authority conferred upon this Council by the Charter of said City.
