HomeMy WebLinkAboutResolution 2022-014 N.C.S. 01/24/2022 DocuSign Envelope ID: ECB4EF99-1D87-4C8E-9E5C-1818F64B4C04 Resolution No. 2022-014 N.C.S. of the City of Petaluma, California RESOLUTION APPROVING THE PURCHASE AND INSTALLATION OF FOUR BUS SHELTERS AND EIGHT BENCHES FROM TOLAR MANUFACTURING CO, INC.,VIA THE CALACT/MBTA COOPERATING PURCHASING AGREEMENT WHEREAS, Petaluma Transit seeks to increase transit ridership throughout the City of Petaluma; and WHEREAS, the City seeks to improve conditions at bus stops throughout the City to help increase transit ridership to help lower vehicles miles traveled and greenhouse gas emissions; and WHEREAS, in partnership with Petaluma City School District, staff has identified two priority locations to receive transit improvements at Casa Grande High School and Kenilworth Junior High School; and WHEREAS,the City wishes to procure bus shelters and benches to be installed at these two locations; and WHEREAS, an option was located to purchase four bus shelters and eight transit benches through a procurement consortium, led by the California Association for Coordinated Transportation(CALACT) and Morongo Basin Transit Authority(MBTA), known as the "Cooperative," Tolar Manufacturing CO, Inc., was a successful bidder; and WHEREAS, the Tolar Manufacturing CO, Inc., shelters and benches will meet the needs for the project sites and compatibility to other Petaluma Transit bus stops; and WHEREAS,upon reviewing quotes provide by the Tolar Manufacturing CO, Inc., staff recommends that the Council authorizes the purchase of four transit shelters and eight transit benches from Tolar Manufacturing CO, Inc., under the terms of the CalACT MBTA Cooperative. WHEREAS,the Petaluma Municipal Code section 4.04.100 provides that purchases made through a cooperative purchasing program with the state, county or other public agencies are exempt from provisions of Chapter 4.04 of the Petaluma Municipal Code which requires the City to conduct its own competitive bid process for certain purchases and documentation as to the advantage of the cooperative purchases will be retained; and WHEREAS,the cost for the shelters will be $49,810 with an estimated installation cost of$2,000, which will be paid for with $40,189 in Transit Development Act (TDA) funding, and$11,621 in Petaluma Traffic Impact Funds (TIF); and WHEREAS, $40,189 in TDA funding is currently allocated and$11,621 in TIF funding will be allocated at a future City Council meeting per a mid-year budget adjustment; and WHEREAS,the proposed action is statutorily exempt from the California Environmental Quality Act (CEQA), in accordance with the Public Resources Code § 21080.25 (Added 1-1-2021 pursuant to SB 288), in that the project meets the definition of a project defined as "Pedestrian and bicycle facilities, including new facilities" and a project for the increase of bus services; and 5 DocuSign Envelope ID:ECB4EF99-1 D87-4C8E-9E5C-1818F64B4C04 WHEREAS, additionally the project is also categorically exempt from CEQA pursuant to Section 15301, as a minor alteration of existing public facilities, Section 15303, as the bus shelters and benches are small structures, and Section 15311, in that the new bus shelters and benches are accessory structures to established uses, and there are no cumulative impacts, unusual circumstances or other factors that would make the exemptions inapplicable pursuant to CEQA Guidelines section 15300.2. NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Petaluma hereby: (1) The above recitals are hereby declared to be true and correct and are incorporated into this ordinance as findings of the City Council. (2) The proposed action is statutorily exempt from the California Environmental Quality Act(CEQA), in accordance with the Public Resources Code § 21080.25 (Added 1-1-2021 pursuant to SB 288), in that the project meets the definition of a project defined as "Pedestrian and bicycle facilities, including new facilities" and a project for the increase of bus services. The project is also categorically exempt from CEQA pursuant to Section 15 30 1, as a minor alteration of existing public facilities, Section 15303, as the bus shelters and benches are small structures, and Section 15311, in that the new bus shelters and benches are accessory structures to established uses. Additionally, there are no cumulative impacts, unusual circumstances or other factors that would make the exemptions inapplicable pursuant to CEQA Guidelines section 15300.2 (3) Authorizes the purchase four transit shelters and eight transit benches from Tolar Manufacturing CO, Inc., via the CALACT/MBTA Cooperating Purchasing Agreement in the amount of$49,810 with an estimated installation cost of$2,000. (4) Directs staff to install the bus stop fixtures at the Casa Grande High School and Kenilworth Junior High School bus stops. (5) Certifies that the installation by staff will be completed by skilled and trained workforce. (6) Authorizes the City Manager, or their designee, to execute all documents necessary to complete the purchase and installation. Under the power and authority conferred upon this Council by the Charter of said City.
