Members of the City Council through City Manager FROM: Larry Zimmer', Capital Improvements Division Manager SUBJECT: Resolution Approving the Project Budget and Authorizing Award of Contract for the Lynch Creek Trail Project. RECOMMENDATION It is recommended that the City Council adopt the attached resolution approving the project budget and authorizing award of contract for the Lynch Creek Trail, Project to Ghilotti Construction Company. BACKGROUND Paved sections of the Lynch Creek Trail lie east of Sonoma Mountain Parkway and west of McDowell Boulevard North. "Between McDowell Boulevard North and Sonoma Mountain Parkway; •the public has. created.a foot path. This project will construct un ADA compliant paved trail to replace the existing, foot path. with an all- weather surface between the Petaluma -Ring Trail and the River Trail, and 'will, close, the existing ,gap. Nine trees (six near McDowell Boulevard North, end and three between Culpepper Drive and Sonoma Mountain Parkway) in conflict with the proposed pathway' will be removed by the contractor during construction. The base bid involves construction of a PCC (Portland Cement Concrete) trail while the alternate bid'involves construction of an asphalt concrete (AC) trail. Staff recommends PCC because it requires less maintenance, has a longer life, and is more resistant to the effects of the existing expansive soil sub- grade. Through, a design consultant,; Works Department staff prepared the bid documents, and a Notice Inviting Bids was issued on May 11, 20 1.1. With bids of $539,546• for the base bid and $628,912 for the alternate bid, Ghilotti Construction Company (GCC) is the apparent low bidder. Staff has verified that GCC - possesses a valid California Contractor's License, Class A, number 644515 that qualifies 'GCC to perform the Project. GCC has performed similar work for various public agencies including the City of Petaluma. DISCUSSI®N Staff recommends authori2ing the City Manager to enter into a contract with the low bidder, Ghilotti Construction Company, for the base bid. If not awarded at this time, the City may not meet the State BTA (Bicycle'Transportation Account) grant requirement to award the contract before September 2011, thus losing the funds. Staff'requests a large contingency (approximately 25 % of the construction contract amount) since the proposed trail is located in undeveloped ,areas; therefore, it is anticipated that the contractor will, encounter many differing site conditions and /or conflicts resulting in contract change orders. The project` will be funded by BTA (Bicycle Transportation Account) grant in the amount of $669,,000, TDA3 (Transportation Development Act Article 3) grant in the amount of $239,546; and Traffic Mitigation Fees in the amount of'$22,000 for CIP overhead (not eligible for grant reimbursement). BTA grant will reimburse up to $669,000 on'lyfofeligible right-of-way acquisition and construction related costs, and TDA3 grant will reimburse up to $306,976 for eligible design, right -of -way acquisition and construction related costs. Any unused BTA and TDA3 funds, including unused contingency, will be returned to� the, respective grant agencies. This project is included (with a slightly larger-' estimate) in the proposed 2011 -2012 CIP which has not yet been approved by Council. ATTACHMENTS 1. Resolution 2. WHEREAS, City staff has- prepared construction bid documents and advertised for construction of this Project; and WHEREAS, in accordance with the City of Petaluma Charter and,.Municipal Code, California Public Contract Code Section 20162 and- other applicable law, City staff solicited bids for the Project; and WHEREAS, the Project was bid on June 9, 2011,. and ten. (-0) bids were received and opened in accordance with applicable law; and WHEREAS; the lowest bid Tor the Project was from Ghilotti Construction Company ( "GCC ") for $539,546 for the base bid; and WHEREAS, staff has determined that GCC's bid satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that GCC possesses a. valid California Contractor's License, Class A, number 644515 that qualifies GCC to perform the Project; and WHEREAS, the Project is exempt pursuant to California Environmental Quality Act A (" CE Q � ") p ursuant to Title 14 the California Code of Re g ' ul" �atlOns' ( "CEQA Guidelines"), Section 15301, as the minor alteration of existing public facilities with negligible or no expansion in use. NOW, THEREFORE, BE.IT RESOLVED that the City Council of the City hereby: 1. Approves the Project Budget in the amount of $930,546 including a construction contingency of $134;000. 2. In accordance with the City, of Petaluma Charter and Municipal Code, California Public r applicable law, waives any and Nall non- conformance in the i b d of GCC for the other Lynch" Creek Trail Project, fin, ds the. bid of ' $539,546 to be the lowest, responsive bid and further finds that GCC is the lowest responsible bidder. 3. Awards the contract for .the Lynch Creek Trail Project to GCC, in the amount of $539,546, the amount of the lowest responsive bid, conditioned on GCC timely executing project- g q the ro ect contract and submitting all required docu ments, including but not limited to, executed bonds certificates of insurance, and endorsements, in accordance with the project bid documents. 4. Directs staff to issue a notice of award to GCC. 0 I 5.
