4 RESOLUTION AMENDING THE DEVELOPMENT PLAN FOR THE KINGSMILL
5 RESIDENTIAL PUD TO INCLUDE THE DEVELOPMENT OF THREE
6 ADDITIONAL HOMES ON LOT 20 OF PHASE 6, A.P. No. 136-540-044
7
8 WHEREAS, by Ordinance No. 1828 N.C.S. dated November 5, 1990, Assessor's Parcel
9 Numbers 136-120-009, 010, and 011 were rezoned from PCD (Planned Community
10 District) to PUD (Planned Unit District) to allow a specific residential development; and
11
12 WHEREAS, by Resolution No. N.C.S. dated November 5, 1990, a Development Plan with
13 accompanying Design Guidelines was adopted for the PUD by the City Council fora 113
14 unit single family residential development on 1131ots; and.
15
16 WHEREAS, an application was subsequently made by Mr. William Wilkinson to amend
17 the PUD Development Plan to allow the development of three additional, adjacent, two
18 story homes on Lot 20 of Phase 6; and
19
20 WHEREAS, the Planning Commission held a public hearing to consider the project on
21 April 26, 1994, at which time the Commission recommended that the City Council
22 conditionally approve an amendment to the Development Plan for the Kingsmill
23 residential PUD to include the development of three additional homes on Lot 20 of Phase
24 6; and

26 WHEREAS, the City Council finds that the requirements of the California Environmental
27 Quality Act and the City of Petaluma Environmental Review Guidelines applicable to this
28 project have been satisfied and hereby incorporates by reference the Mitigated Negative
29 Declaration approved by Resolution No. sn-126 N.C.S. dated May 16, 1994;

31 NOW, THEREFORE, BE IT RESOLVED that the amended Development Plan for the
32 Kingsmill Residential PUD are hereby approved pursuant to Section 19A-504 of the
33 Zoning Ordinance No. 1072 N.C.S., as amended; and

35 BE IT FURTHER RESOLVED that the City Council hereby adopts the findings, stated
36 hereinafter;

38 Findings for PUI) Amendment:
39 1. The amendment to the PUD Development Plan to provide for the development of
40 three additional units on Lot 20 of Phase 6 of the Kingsmill Single Family

1 Residential Subdivision will result in a more desirable use of the land and a better
2 physical environment than would be possible under any single zoning district or
3 combination of zoning districts.

5 2. The amendment to the PUD Development Plan to provide for the development of
6 three additional units on Lot 20 of Phase 6 of the Kingsmill Single Family
7 Residential Subdivision is proposed on property which has a suitable relationship to
8 one (1) or more thoroughfares and that said thoroughfares are adequate to carry
9 any additional traffic generated by the development.

11 3. The amendment to the PUD Development Plan to provide for the development of
12 three additional units on Lot 20 of Phase 6 of the Kingsmill Single Family
13 Residential Subdivision presents a unified and organized arrangement of buildings
14 and service facilities which are appropriate in relation to adjacent or nearby
15 properties and that adequate landscaping and/or screening is included as necessary
16 to insure compatibility.

18 4. The natural and scenic qualities of the site are protected, with adequate available
19 public and private spaces designated on the PUD Development Plan (and
20 amendment) to provide for the development of three additional units on Lot 20 of
21 Phase 6 of the Kingsmill Single Family Residential Subdivision.

23 5. That the development of the subject property, in the manner proposed by the
24 applicant, will not be detrimental to the public welfare, will be in the best interests
25 of the City, and will be in keeping with the general intent and spirit of the zoning
26 regulation of the City of Petaluma, with the Petaluma General Plan, and with any
27 applicable plans adopted by the City.

29 BE IT FURTHER RESOLVED that the City Council hereby approves the PUD
30 Development Plan amendment to include three additional units on Lot 20 of .Phase 6 of the
31 Kingsmill Subdivision as indicated on the plan submitted on December 29, 1993, subject to
32 the approved Kingsmill PUD Design Guidelines for this phase with the exception to allow
33 for the development of three adjacent two story homes, subject to the conditions previously
34 adopted and set forth in Resolution 90-365 N.C.S., adopted November 5, 1990, and
35 augmented as hereinafter set forth, as follows:

1, Conditions for the Amendment to the PUD Development Plan:
2 1. The adjacent property to the east of the site is presently owned by the City. A
3 commercial baseball facility is being considered to be established on this property.
4 A disclosure statement shall be recorded advising prospective property
5 owners/residents of the above facts. Any future subdivision map and resulting grant
6 deeds shall include said disclosure statement, subject to staff review and approval
7 prior to Tentative Parcel Map approval.

9 2. One (1) reproducible sepia copy of the amended PUD Plan shall be submitted for
10 staff review and approval prior to Tentative Parcel Map approval.

12 3. Public landscaping and the landscaping of the front yards shall conform with the
13 approved landscape plans for the Kingsmill Subdivision prior to acceptance. of
14 public improvements or issuance of a Certificate of Occupancy respectively.

16 4. The existing home is inconsistent with the PUD Design Guidelines. With the
17 creation of the subsequent Parcel Map for this Amendment to the PUD
18 Development Plan, a deed restriction shall be recorded with the lot containing the
19 existing home which shall require its removal upon the sale of said parcel, subject to
20 staff review and approval prior to Parcel Map approval. Future development of said
21 lot shall be subject to the adopted Design Guidelines for the Kingsmill Subdivision.

23 5. Units shall be subject to Administrative SPARC with emphasis on redesign to
24 include rear or side entry garages and/or recessed garages.
