S . of the City of Petaluma, California A RESOLUTION OF THE CITY COUNCIL OF CITY OF PETALUMA AUTHORIZING FUNDING IN AN AMOUNT UP TO $191009000 AS A SHORT-TERM CASH FLOW LOAN AS LOCAL MATCH FOR THE HOMEKEY PROJECT, THE STUDIOS AT MONTERO WHEREAS, the Department of Housing and Community Development ("Department") has issued a Notice of Funding Availability, dated September 9, 2021 ("NOFA"), for the Homekey Program ("Homekey" or "Program") and the Department has issued the NOFA for Homekey grant funds pursuant to Health and Safety Code section 50675. 1 .3 (Assembly. Bill No. 140 (2021 -2022 Reg. Sess.), § 20.); and WHEREAS, pursuant to a Resolution adopted by the City Council on December 6, 20215 City of Petaluma ("Co-Applicant") jointly applied for Homekey grant funds with Burbank Housing Development Corporation ("Corporation") and therefore, Co-Applicant joined the Corporation in the submittal of an application for Homekey funds ("Application") to the Department for review and consideration and the project was awarded funding by HCD on March 1 , 2022; and WHEREAS, the Department is authorized to administer Homekey pursuant to the Multifamily Housing Program (Chapter 6.7 (commencing with Section 50675) of Part 2 of Division 31 of the Health and Safety Code) and Homekey funding allocations are subject to the terms and conditions of the NOFA, the Application, the Department- approved STD 213, Standard Agreement ("Standard Agreement"), and all other legal requirements of the Homekey Program; and ' WHEREAS, this proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA in accordance with Assembly Bill 83 (2020) establishes a statutory exemption from the California Environmental Quality Act (CEQA) for activities funded by Homekey (Health & Safety. Code, § 50675 . 1 .2.); and WHEREAS, this Project is also likely exempt pursuant to Senate Bill 450 (2019) as this Project is a qualifying interim motel housing project that provides transitional and supportive housing and that does not (1) result in the expansion of more than 10 percent of the floor area of any individual living unit in the structure or (2) result in any significant effects relating to traffic, noise, air quality, or water quality; and WHEREAS, additionally, this Project is exempt from CEQA pursuant to Section 21080(b)(4) of the Public Resources Code and Section 15269(c) of the State CEQA Guidelines, which exempts specific actions necessary to prevent or mitigate an emergency, the current homelessness crisis facing the City; and WHEREAS, this project is also categorically exempt pursuant to CEQA Guidelines Section 15301 (operation, repair, leasing, or minor- alteration of existing structures) because the Project consists of the renovation of an existing motel for interim housing purposes with negligible or no expansion of its existing or former use. DocuSign Envelope ID: 564B7E4C-6B59-4B94-AFCC-AO7FBCAF4BOD NOW, THEREFORE, BE IT IS RESOLVED THAT by the City Council of the City of Petaluma as follows: The foregoing recitals are true and correct are incorporated herein by as findings of the City Council. 1 . Finds that the proposed action of the City Council adopting the Resolution approving a short-term (maximum 12-month period) cash flow loan of up to $ 1 , 100,000.00 (One Million One Hundred Dollars) from City General Fund for local match required to receive the State of California Housing and Community Development (HCD) Homekey 2 award of $ 15,680,832; and 2 . Finds that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with Assembly Bill 83 (2020) which establishes a statutory exemption from the California Environmental Quality Act (CEQA) for activities funded by Homekey. (Health & Safety. Code, § 50675 . 1 .2.) City is hereby authorized if the project is awarded HCD grant funding to provide up to $ 1 , 100.00 (One Million One Hundred Dollars) as a short-term loan from the City general fund for local match required for the Homekey Project, The Studios at Montero. 4. The Application was approved by HCD on March 1 , 2022 and Co-Applicant is hereby authorized and directed to enter into, execute, and deliver a Standard Agreement in a total amount not to exceed $15,680,382, (Fifteen Million, Nine Hundred Eighty Thousand, Three Hundred Eighty-Two Dollars) any and all other documents required or deemed necessary or- appropriate to secure the Homekey funds from the Department and to participate in the Homekey Program, and all amendments thereto (collectively, the "Homekey Documents"). 5 . Co-Applicant acknowledges and agrees that it shall be subject to the terms and conditions specified in the Standard Agreement, and that the NOFA and Application will be incorporated in the Standard Agreement by reference and made a part thereof. Any and all activities, expenditures, information, and timelines represented in the Application are enforceable through the Standard Agreement. The City Manager or her designee is authorized to execute the Application, or any other documentation needed as part of the Application and the Homekey Documents on behalf of Co-Applicant for participation in the Homekey Program.
