of the City of Petaluma, California
RESOLUTION ACCEPTING COMPLETION OF THE MCNEAR PARK WATER
AND SEWER MAIN REPLACEMENT PROJECT (C67502020 & C66402143)
BY W.R. FORDE ASSOCIATES, INC.
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents
and solicited bids for the McNear Park Water and Sewer Replacement Project (C67502020 &
C66402143); and
WHEREAS, the project was bid on January 7, 2021, and bids were received and opened on January
28, 2021, in accordance with applicable law; and
WHEREAS, the lowest responsible bid for the project was submitted by W.R. Forde Associates Inc.
from Richmond, CA for $2,365,830; and
WHEREAS,by Resolution No 2021-020 N.C.S. adopted February 22, 2021, the City council found
the bid of$2,365,830 for the project to be the lowest responsive bid, awarded the project to W.R. Forde
Associates Inc., conditioned on W.R. Forde's timely executing the project contract and submitting all
required documents and authorized and directed the City Manager to sign the project agreement on behalf
of the City; and
WHEREAS,the following contract change orders (CCO) for additional replacement of sewer main,
water main, emergency repair work, additional paving and concrete work, and misc. construction items
affecting the project amount have been approved:

Change Order#3 $ 203,336.60
Change Order#4 $ 246,866.92
Total Change Orders $ 785,279.54; and
WHEREAS, the final contract amount, as amended, including all change orders, overruns, and
underruns, is $3,151,109.54 and is within the approved project budget; and
WHEREAS, environmental compliance was already analyzed with February 22, 2021, Resolution
Awarding the Construction Contract, when the City Council found that this project is categorically
exempt under the California Environmental Quality Act("CEQA")pursuant to Article 19, Section
15301(c), of Title 14 of the California Code of Regulations ("CEQA Guidelines")because the project
consists of the repair, maintenance, and minor alteration of existing public facilities involving negligible
or no expansion of existing or former use and the improvements will repair existing deteriorated water
services and water main services without changing the use of those facilities, and there is negligible or no
expansion of use beyond what currently exists and there are no cumulative impacts, unusual
circumstances, or other factors that would make the exemption inapplicable pursuant to CEQA Guidelines
Section 15300.2.; and

WHEREAS, based on the foregoing, staff recommends acceptance of the project on behalf of the
City.
NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Petaluma hereby:
1. Declares the above recitals to be true and correct and are incorporated into this resolution as findings
of the City Council.
2. The contract titled McNear Park Water and Sewer Main Replacement Project(C67502020 &
C66402143), with the final contract amount of$3,151,109.54 is accepted as complete, subject to
the contractor's continuing warranty and other obligations pursuant to the contract.
3. Environmental compliance was already analyzed with Resolution Awarding the Construction
Contract, February 22, 2021, when the City Council found that this project is categorically exempt
under the California Environmental Quality Act ("CEQA")pursuant to Article 19, Section 15301(c),
of Title 14 of the California Code of Regulations ("CEQA Guidelines")because the project consists
of the repair, maintenance, and minor alteration of existing public facilities involving negligible or
no expansion of existing or former use. The improvements will repair existing deteriorated water
services and water main services without changing the use of those facilities. Accordingly, there is
negligible or no expansion of use beyond what currently exists and there are no cumulative impacts,
unusual circumstances, or other factors that would make the exemption inapplicable pursuant to
CEQA Guidelines Section 15300.2. A Notice of Exemption was filed in February 2021 with the
County of Sonoma for the Project.
4. The City Clerk is hereby authorized and directed to file a Notice of Completion concerning the
project with the Sonoma County Clerk's office within ten(10) days of the date of this Resolution.
5. Staff are hereby authorized and directed to release all undisputed retention not subject to pending
change orders within sixty(60) days of the date of this Resolution and in accordance with the terms
of the project contract, California Public Contract Code Section 7107, and applicable law.
Under the power and authority conferred upon this Council by the Charter of said City.
