Of the City of Petaluma, California RESOLUTION ACCEPTING THE COMPLETION OF THE COMMUNITY CENTER GENERATOR PROJECT BY JAMES DAY CONSTRUCTION WHEREAS,by Resolution No. 2021-131 adopted August 2, 2021, the City Council of the City of Petaluma delegated authority to the City Manager to award a construction agreement to an electrical contractor for the project; and WHEREAS, City staff has prepared construction bid documents and advertised for construction for the Community Center Generator Project C11202116 ("Project"); and WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the project; and WHEREAS,the bid for the project was opened on August 5, 2021, in accordance with applicable law; and WHEREAS,the apparent low bid for the project was the bid of James Day Construction from Clearlake, CA for$99,989.00; and WHEREAS,two contract change orders were executed affecting the project amount, the final construction contract amount as amended is $108,998.04; and WHEREAS, City staff have inspected the project and determined that it has been completed in substantial accordance with the contract requirements subject to the contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS, environmental compliance was already analyzed with Council Resolution, on August 2, 2021, which was determined to be categorically exempt pursuant to the California Environmental Quality Act under Title 14, the California Code of Regulations Section 15302, because the project consists of reconstruction of existing systems and/or minor new construction involving negligible or no expansion of capacity WHEREAS,based on the foregoing, it is recommended that Council accepts the project on behalf of the City. NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Environmental compliance was already analyzed with Council Resolution, August 2, 2021, which was determined to be categorically exempt pursuant to the California Environmental Quality Act 5 DocuSign Envelope ID:F25FF3B2-BO72-442B-9F4A-OD482A9F3CD2 under Title 14, the California Code of Regulations Section 15302,because the project consists of reconstruction of existing systems and/or minor new construction involving negligible or no expansion of capacity. 3. The contract entitled Community Center Generator Project No. C 11202116 with a final construction contract amount of$108,998.04 is accepted as complete subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 4. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the project with the Sonoma County Clerk's Office within ten(10) days of the date of this Resolution. 5. Staff is hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty(60) days of the date of this Resolution and in accordance with the terms of the project contract, the Petaluma City Charter, California Public Contract Code Section 7107, and applicable law.
