Resolution No. 2022-050 N.C.S.
of the City of Petaluma, California
RESOLUTION ACCEPTING COMPLETION OF THE MULTI-USE PATH
PRINCE PARK TRAIL PROJECT C14502009
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents and
solicited bids for the Multi-Use Path—Prince Park Tail Project C14502009 (Project); and
WHEREAS, the project was bid on March 26, 2021, and five (5) bids were received and opened on
April 22, 2021, in accordance with applicable law; and
WHEREAS, the lowest responsible bid for the project was submitted by Michael Paul Construction
Inc. from Petaluma, CA for$56,255; and
WHEREAS,by Resolution No 2021-070 N.C.S. adopted May 17, 2021,the City council found the bid
of$56,255 for the project to be the lowest responsive bid,awarded the project to Michael Paul Construction
Inc., conditioned on Michael Paul Construction's timely executing the project contract and submitting all
required documents and authorized and directed the City Manager to sign the project agreement on behalf
of the City; and
WHEREAS, one contract change order was issued which approved an additional $5,000 to cover
unexpected material costs incurred by Michael Paul Construction, Inc.; and
WHEREAS, the final contract amount, as amended, including all change orders, overruns, and
underruns, is $61,255 and is within the approved project budget; and
WHEREAS, environmental compliance was already analyzed with Resolution Awarding the
Construction Contract, on May 17, 2021, when the City Council found that this project is categorically
exempt pursuant to the California Environmental Quality Act ("CEQA") pursuant to Article 19, Section
15301(c), of Title 14 of the California Code of Regulations ("CEQA Guidelines"), because the project
consists of the repair,maintenance, and minor alteration of existing public facilities involving negligible or
no expansion of existing or former use and the improvements will repair and maintain existing pedestrian
travel ways and related facilities without changing the use of those facilities; and
WHEREAS,based on the foregoing, staff recommends acceptance of the project on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby:
1. Declares that the above recitals to be true and correct and are incorporated into this Resolution as
findings of the City Council.
2. The contract titled Multi-Use Path — Prince Park Trail Project C14502009, with the final contract
amount of$61,255 is accepted as complete, subject to the Contractor's continuing warranty and other
obligations pursuant to the contract.

3. Finds that environmental compliance was already analyzed with Resolution Awarding the
Construction Contract,on May 17,2021,when the City Council found that this project is categorically
exempt pursuant to the California Environmental Quality Act ("CEQA") pursuant to Article 19,
Section 15301(c), of Title 14 of the California Code of Regulations ("CEQA Guidelines"), because
the project consists of the repair, maintenance, and minor alteration of existing public facilities
involving negligible or no expansion of existing or former use and the improvements will repair and
maintain existing pedestrian travel ways and related facilities without changing the use of those
facilities. Accordingly, there is negligible or no expansion of use beyond what currently exists and
there are no cumulative impacts, unusual circumstances, or other factors that would make the
exemption inapplicable pursuant to CEQA Guidelines Section 15300.2. A Notice of Exemption was
filed in May with the County for the Project.
4. The City Clerk is hereby authorized and directed to file a Notice of Completion concerning the
project with the Sonoma County Clerk's office within ten(10) days of the date of this Resolution.
5. Staff are hereby authorized and directed to release all undisputed retention not subject to pending
change orders within sixty (60) days of the date of this Resolution and in accordance with the terms
of the project contract, California Public Contract Code Section 7107, and applicable law.
Under the power and authority conferred upon this Council by the Charter of said City.
