of the City of Petaluma, California
RESOLUTION AUTHORIZING LETTERS OF COMMITMENT FOR THE CALIFORNIA FIRE
SAFE COUNCIL 2022 STATE FIRE ASSISTANCE GRANT PROGRAM
WHEREAS,the California Fire Safe Council has provided funds from a U.S. Forest Service grant for
the 2022 State Fire Assistance grant program; and
WHEREAS, the grant program requires a dollar-for-dollar non-federal match, either in cash or in-kind
contributions; and
WHEREAS, the procedures established by the California Fire Safe Council require applicants to sign
and provide letters of commitment with the sources of the non-federal match; and
WHEREAS, the Applicant/Sub-Grantee, if preliminarily selected, will enter into a pre-award process
with the California Fire Safe Council; and
WHEREAS, the City of Petaluma has identified the need for funding a defensible space program; and
WHEREAS, the City of Petaluma has the legal authority and is authorized to enter into a funding
agreement with the State of California; and
WHEREAS, the City of Petaluma intends to apply for grant funding from the California Fire Safe
Council for hazardous fuels reduction projects and wildfire prevention outreach; and
WHEREAS,approving a resolution to apply and for grant funding does not constitute a"project"under
the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378 as this
action is an organizational and administrative act and because the action does not commit the City to a
definite course of action (See City of Irvine v. County of Orange (2013) 221 Cal 4th 846, 865 (County's
decision to apply for state funding for potential jail expansion was not project approval); and
WHEREAS, if the proposed action did constitute a"project pursuant to the California Environmental
Quality Act," this action is exempt pursuant to CEQA Guidelines Sections 15304 (Minor Alterations to
Land) as, if awarded, the City will utilize the funds to remove vegetation for the purpose of fuel
management.
NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Petaluma hereby:
1. Declares the above recitals to be true and correct and are incorporated into this resolution as
findings of the City Council.
2. That pursuant and subject to all of the terms and provisions of the California Budget Act of
2021, the City of Petaluma City Manager, or designee is hereby authorized and directed to
prepare and file letters of commitment of non-federal match funding and take such other actions
necessary or appropriate to filing applications for grant funding.
3. The City of Petaluma City Manager, or designee is hereby authorized and directed to execute
the funding agreement with the California Fire Safe Council and any amendments thereto.

4. The City of Petaluma City Manager,or designee is hereby authorized and directed to submit any
required documents, funding requests, and reports required to obtain grant funding.
5. Certifies that the project will comply with any laws and regulations including, but not limited
to, the California Environmental Quality Act (CEQA), legal requirements for building codes,
health and safety codes, the California Labor Code, disabled access laws, and that prior to
commencement of the project, all applicable permits will have been obtained.
6. Finds that approving a resolution to apply and for grant funding does not constitute a"project"
under the California Environmental Quality Act(CEQA)pursuant to CEQA Guidelines Section
15378 as this action is an organizational and administrative act. However, if awarded the
activities would be exempt pursuant to CEQA Guidelines Sections 15304 (Minor Alterations to
Land) as if awarded the City will utilize the funds to remove vegetation for the purpose of fuel
management.
