RESOLUTION APPROVING THE ROUTE AND SIGN PROGRAM
FOR THE BAY AREA RIDGE TRAIL
WHEREAS, the Bay Area Ridge Trail Council received City Council support for the
concept of a trail route through the City of Petaluma on May 1, 1989; and
WHEREAS, the City of Petaluma General Plan encourages the provision of bike and
pedestrian trails through the City.
12 NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council approves the
13 proposed ridge trail route to connect the Petaluma Adobe Historic State Park to McNear
14 Park, and authorizes staff to proceed with coordination with the Bay Area Ridge Trail staff
15 to insure the compliance with the following conditions:

17 1. Encroachment permits for the placement of trail identification signs along the
18 approved route shall be obtained by the Bay Area Ridge Trail organization, prior to
19 placement of any trail identification.

21 2. The Bay Area Ridge Trail Council shall defend, indemnify, and hold harmless the
22 City or any of its boards, commission, agents, officers, and employees from any
23 claim, action or proceeding against the City, its boards, commission,. agents, officers,
24 or employees to attack, set aside, void, or annul, the approval of the project when
25 such claim or action is brought within the time period provided for in applicable
26 State and/or local statutes. The City shall promptly notify the Bay Area Ridge Trail
27 Council of any such claim, action, or proceeding. The City shall coordinate in the
28 defense. Nothing contained in this condition shall. prohibit the City from
29 participating in a defense of any claim, action, or proceeding if the City bears its
30 own attorney's fees and costs, and the City defends the action in good faith.

32 3. The Bay Area Ridge Trail Council shall assume all responsibility for maintenance of
33 trail identification signs.

35 4. Should the Bay Area Ridge Trail Council cease to exist, all signs within the City of
36 Petaluma shall be removed, to City staff's satisfaction, at the expense of the Bay
37 Area Ridge Trail Council.

2 5. No expansion or modification of ridge trail route, within the City of Petaluma, shall
3 be undertaken without review and approval of the City Council of the City of
4 Petaluma.
