HomeMy WebLinkAboutResolution 2022-102 N.C.S. 06/06/2022 DocuSign Envelope ID:AE38B657-EABC-4ADB-9476-5EF6DFF40078 Resolution No. 2022-102 N.C.S. of the City of Petaluma, California AUTHORIZING THE PURCHASE OF ONE (1) 2022 Toyota BZ4X IN THE AMOUNT OF $48,922 PLUS TAX AND THE PURCHASE OF ONE (1) 2022 FORD MACH-E IN THE AMOUNT OF $63,890 PLUS TAX, AND AN ESTIMATED $6,257 EACH VEHICLE FOR THE PURCHASE OF STANDARD POLICE PATROL ACCESSORY EQUIPMENT,AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO COMPLETE THE PURCHASE WHEREAS, the City of Petaluma Police Department has identified a need to evaluate the use of an all- electric administrative vehicle prior to commencing with an all-electric patrol vehicle pilot project; and WHEREAS, the City has adopted a Climate Emergency Action Framework establishing a goal for eliminating transportation emissions through the encouragement of and support for non-combustion vehicles; and WHEREAS, the City has identified key strategic initiatives within their goals and priorities to reduce greenhouse gas emissions and minimize use of fossil fuels; and WHEREAS, the City seeks to determine if there are reasonable low climate pollution alternative emergency vehicles and equipment available suitable for daily police administrative operations and emergency response use; and WHEREAS, the City has identified the Toyota BZ4X and Ford Mach-E vehicles as suitable all-electric vehicles for evaluation as a police administrative vehicle; and WHEREAS,Petaluma Municipal Code Section 4.04.050 provides that"when the commodity can be obtained from one vendor"the City may dispense with the formal and informal bidding procedures stated in Chapter 4.04 of the Petaluma Municipal Code; and WHEREAS, due to significant supply chain impacts and fuel costs caused by the pandemic, availability of all-electric vehicles is scarce; and WHEREAS, City staff reached out to numerous dealerships, including those on the State Bid, to inquire on the availability and timeline for all-electric vehicles and currently, there are no available all-electric vehicles available except for Hansel Toyota; and WHEREAS, Hansel Toyota is taking delivery on one (1) all-electric Toyota BZ4X and they have agreed to reserve the vehicle for the Petaluma Police Department and is securing a reservation for a Ford Mach-E through communications with Ford's Regional Governmental Sales Manager and the Hansel dealership; and WHEREAS,the City has determined Toyota is the sole source for the Toyota BZ4X vehicles and Ford as the sole source for the Ford Mach-E vehicles because, the Toyota BZ4X and Ford Mach-E are the only electric vehicles that are large enough to meet the Department's needs and is available within the City's timeframe; and WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that purchasing a Toyota BZ4X does not meet CEQA's definition of a "project," because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, Resolution No. 2022-102 N.C.S. Relatedly, if the proposed action did constitute a project under CEQA the action is exempt under the common-sense exemption, CEQA Guidelines Section 15061(b)(3) as the use of a Toyota BZ4X will reduce emissions from a standard vehicle. NOW, THEREFORE, BE IT RESOLVED,that the City Council of the City of Petaluma hereby: 1. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Finds that proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that purchasing a Toyota BZ4X does not meet CEQA's definition of a"project,"because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. Relatedly, if the proposed action did constitute a project under CEQA the action is exempt under the common-sense exemption, CEQA Guidelines Section 15061(b)(3) as the use of a Toyota BZ4X will reduce emissions from a standard vehicle. 3. Finds that the City satisfied the purchasing requirements of the City Charter and Chapter 4.04 of the Petaluma Municipal Code as both the Toyota BZ4X and the Ford Mach-E are sole source commodities that only one vendor sells. Additionally,the Toyota BZ4X and the Ford Mach-E are the only electric vehicles that are large enough to meet the Department's needs, and are available within the City's timeframe due to supply chain issues. Moreover, emergency equipment manufacturers have prefabricated emergency equipment for installation in this model,which is not available with other electric vehicles. 4. Approves the purchase of one 2022 Toyota BZ4X from Hansel Toyota in the amount of$48,922,plus tax and the purchase of one 2022 Ford Mach-E from Hansel Ford in the amount of 63,890 plus tax, and an estimated$6,257 each vehicle for purchase of standard accessory equipment. 5. Authorizes the City Manager, or her designee, to execute any necessary agreements and documents to complete the purchase of the vehicles and related equipment. Under the power and authority conferred upon this Council by the Charter of said City.
