HomeMy WebLinkAboutResolution 94-157 06/20/1994Resolution No. s4-157 N.C.s. of the City of Petaluma, California 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 APPROVING WASTEWATER TREATMENT FACILITY PROPOSAL EVALUATION METHODOLOGY WHEREAS, the City of Petaluma is conducting a procurement process for development of a new wastewater treatment facility; and WHEREAS, the Wastewater Facility Citizens' Cortunittee has recommended a particular methodology for review of the proposals which will be received. NOW, THEREFORE, BE IT RESOLVED that the wastewater facility proposal evaluation methodology attached herein as Exhibit A is hereby approved and adopted. Under the power and authority conferred upon this Council by the Charter of said City. Receive proposals. 2, Information contained in proposals sha11 be subject'to ~` disclosure except to the minimum extent of~the City's need to engender vendor competition and to the extent of the proposer's ability to protect the information under the Public Records Act. 3. If the R1=1' solicits. proposals for morethan:. one option or form of contract, City staff shall separate proposals info categories, o;ne fior each type of contract and option sought. If a proposer has submitted a proposal for more than one contract or option, it; shall be entered into each category for which it'is submitting. 4. City staff, with consultant assistance as requested, will initially evaluate. the responsiveness of each proposal and the responsibi ity.of each; proposer. 5'. If .City staff initially determines that any proposal or propo er fails to meet the responsiveness/responsibility criteria, it may waive any deficiencies.,. may request from the deficient proposer or the proposer subrni,tting a deficient proposal clarification or additional information regarding thepoints of concern or may prepare a report Re..so. q~}_...~ 5~ KGs re,cornmending,tpe. rejection of`any such propo als or all proposals submitted by any such proposer: 6: Upon receipt of any such. information; City staff sha'II- again initially determine responsiveness/responsibility, waive -any deficiencies or prepare a' report recommending rejection of the proposer/proposal. 7. - City staff will present to tfie Cifiizen Advisory Committee for comment anysuch report recommending rejection of a proposal: or proposer. If the Committee dete:rm'ines it needs further information, it may ask that staff consider pi:~blic disclosure of such additional information for the Committee's use. If any. such information may .be protected from disclosure. under the Public Records Act; the Committee may request staff to consider asking the proposer, to voluntarily release the information publicly for Committee consideration. 8. City staff will present anysuch report for action by-the City Council, which may result in a waiver of the deficiencies, a request for alarifiication or more `information, a rejection of the proposal/proposer or other action consistent with the RA=P. 9.; City, staff` shall evaluate and snore., in accordance with the criteria set forth in the R'FP, all proposals not rejected during the responsiveness/responsibility review. City staff may' request assistance from the consultant team 'in the evaluation process,, .but their work product shall be in the nature of recommendations and support; actual evaluation and scoring of 'the proposals hall be the responsibility of staff. City staff may, at its election, utilize, written questions and answers and oral interviews and presentations to aid in the evaluation process. 11. Upon completion of evaluation and scoring,. City staff shail rank the. proposals. I'f`th'e City requested proposals for more than one form of contractor option., City- staff shall rank the proposals within each category of options and contract forms requested. 12. City staff; with consultant support as requested, will prepare a report recommending .either that (a) all proposals be rejected:' or (b) that one or more proposals within on°e or more categories be the subject of negotiations. 13. City staff wilt present such report and recommendation to the Citizens Advisory Committee for .comment. If the Committee ' determines it needs, further i'nforniation, it may ask that staff consider public disclosure of`~such additional information for the Committee's use. 1f any such information may be protected from disclosure under the Public Records Act; the Committee may request staff to consider asking the proposer to voluntarily release the information publicly for Committee consideration. 14. City staff will .present the report and recommendations to the City Council and will seek Council approval of the recommendation or -3- 9412601X.LA1 R2so, qH--15~ NGS .- Council direcfion'to reject all prop"osals .or to broaden, or narrow the number of proposals to be the subject of negotiations. 15: Assuming the City C:ouneil .approves negotiations on one or more proposals, City staff., with support from~the consultant team as requested,, will undertake the negotiafioris so directed.. 16. If at any time City staff wishes to terminate or suspend ne~goti'ations with any .,proposer or orn any proposal, it steal prepare a report to the Citizens Advisory Committee for cornrnent recommending the action:. If'the Committee .determines it needs clarification or further information. it may ask that "staff consider public disclosure of such additional documentation. If such information may be protected from disclosure under the Public Records Act', the Committee may request staff to consider .asking the proposer to voluntarily release the information publicly for Committee consideration. 17. Citystaff (hereafter wilt forward such recommendation. to the City Council to obtain direction consistent with: the RFP. 18. City staff may, at its election, seek from the negotiating proposer or proposers best and. final offers: 19. At any point City. staff feels proposer negotiations indicate it appropriate to do so, City staff shalt prepare a report to the Citizens Advisory Commit#ee for comment recommending either (a) the termination of the procurement or .(b) the award of a contract. If the Committee determines it needs .clarification or .further inforrnafion, it may ask that staff consider public disclosure of such additional documentation.
