SUBJECT: Resolution Accepting Completion of the East Washington Street Reconstruction
Project
RECOMMENDATION
It is recommended that the City 'Council adopt the attached resolution accepting completion of
the East Washington Street Reconstruction Project.
BACKGROUND
The Department of.Public'Works prepared a street reconstruction maintenance plan for - this
project to repair damage caused by a.ruptured water main. Bids were opened on March 23,
2011, and on April 18 the City Council awarded the constru contract to FEDCO
Construction, Inc. ( "Contractor ") for $23
DISC1SSION
The Contractor has satisfactorily completed the coristru_ction contract for $23,171. There were
noxhange orders necessary for the project. The estimated total cost of the,,project, including
construction contract, construction;management and °inspecti'on; design, administration and
overhead, is $27,971.
Per contract requirements,, retention will be released within sixty ,days after Council acceptance
of�this project.. Staff recommends.accepting completion of the construction contract now that
FE'DCO Construction,,, Tnc. has fulfilled all, contract requirements. Approval of 'this - resolution ,
will assure release of'retention to the Contractor.
FINANCIAL, IMPACTS
The estimated total.cost of the project, including construction contract construetion.management
and inspection, design, administration, and overhead, is $27,971. A total project budget of
$34,971 from the Water Utility Fund (6700-67700-54151 -E6700201 1) was authorized by
Resolution 2011 -059 N.C.S'•. on April 18, 2011. The unused budget will be returned to the Water
Utility Fund.

RESOLUTION ACCEPTING COMPLETION OF THE
EAST WASHINGTON STREET RECONSTRIJCTTON PROJECT
WHEREAS, in accordance with Section 68° of Article X of City of Petaluma Charter,
Section 20162 of the California'Public;'Contract Code and other applicable law, the City of
Petaluma solicited bids for the,E'ast. Washington Street Reconstruction Project ( "Project "); and
WHEREAS, bids for the Project were opened on March 23, 2011 at 3:00 PM in accordance with
California Public Contract Code Section. 4104.5 and other applicable law; and
WHEREAS, the apparent low,bid for the Project was the bid of FEDCO Construction, Inc. in
the amount of $23,171; and
WHEREAS, by Resolution No. 2011 -059 N.C.S., adopted April 18, 2011 the City Council of
the City of Petaluma, found the bid of $23,174 for the Projectto be the lowest responsive bid and
awarded the Project to FEDCO Construction Inc. in the amount of $23,171 conditioned on
FEDCO Construction's timely ,executing the Project contract and submitting all required
documents and authorized and directed the City Manager to sign the Project contract on behalf of
the City upon such timely submission and to execute on behalf of the City any change orders and
other amendments to the Project contract that are necessary to effectively complete the project
and /or to realize the Project and /or cost benefits for the City so long as such change orders or
amendments do not result in an.increase in excess of thirty percent of the total Project amount;
and
WHEREAS, the following; change orders affecting the Project amount have been approved:

WHEREAS, the final contract amount as amended including all change'orders is'$23,;17'1; and
WHEREAS, City staff 'have, inspected the Project and determined that.it has been,completed in
accordance with the contract requirements subject to the Contractor's continuing warranty and
other obligations pursuani to the contract; and

WHEREAS, "based on the foregoing, staff recommends acceptance of the Project on behalf of
the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as
follows:
1. The contract entitled East Washington : Street Reconstruction Project No. E67012011
with a final. contract�amount of °$23,1'71' is accepted as complete subject to the
Contractor's continuing' and other obligations pursuant to the contract.
2. The City Clerk/Recordng Secretary, is hereby authorized and,directed to file a. Notice
of Completion concerning the Project with the Sonoma County Clerk's Office within
ten (10) days of the date 'of this Resolution.
3. Staff are hereby authorized and directed to.xelease all undisputed.retention not subject
to pending change orders within sixty (60) days of the date of this .Resoiution:and' in.
accordance with the terms of the Project contract,. California. Public Contract Code
Section 7107 and applicable law.
