REPEALING RESOLUTION NO. 98-126 N.C.S. TO ELIMINATE THE ANIMAL SERVICES ADVISORY COMMITTEE WHEREAS, the Animal Services Advisory Committee was established by the City Council on June 22, 1998
with Resolution No. 98-126 N.C.S.; and WHEREAS, the City Council has updated the responsibilities of the Animal Services Advisory Committee from time to time; and WHEREAS, the City Council most recently updated and affirmed the responsibilities of the Animal Services Advisory Committee in 2013 with Resolution No. 2013-038 N.C.S.; and WHEREAS, the contract with the City’s current animal services provider, North Bay Animal Services, has oversight provisions built into the agreement, such as providing bi-annual reports, an annual audit, and required
responses to Public Records Act requests; and WHEREAS, based on the current responsibilities outlined in Resolution No. 2013-038 N.C.S., the Committee does not serve an oversight role vis-a-vis the animal services provider; and WHEREAS, eliminating the Animal Services Advisory Committee is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378(b)(5), in that eliminating the Animal Advisory Committee does not meet CEQA's definition of a “project,” because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and because the action constitutes organizational or
administrative activities of governments that will not result in direct or indirect physical changes in the environment; and WHEREAS, City staff and the City Council have determined that the Animal Services Advisory Committee is no longer needed for the purposes for which it was originally established.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Petaluma as follows: 1. Declares that the above recitals are true and correct and are incorporated into this resolution as findings of the City Council.
2. Finds that eliminating the Animal Services Advisory Committee is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378(b)(5), in that eliminating the Animal Advisory Committee does not meet CEQA's definition of a “project,” because the action does not have the potential for resulting in either a direct physical change in the environment or a
reasonably foreseeable indirect physical change in the environment, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. 3. Resolution No. 98-126 N.C.S. is hereby repealed in its entirety and the Animal Services Advisory Committee
is hereby eliminated.
