HomeMy WebLinkAboutResolution 94-217 08/08/1994 r~ FZ~S~IL~tlOrl N®. 94-217 N of the City of Petaluma, California CALLING AND GIVING NOTICE OF A SPECIAL 1VIUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 8, 1994, FOR SUBMISSION TO THE VOTERS OF AN ADVISORY INITIATIVE MEASURE REQUESTING THE CITY COUNCIL TO GIVE WASHINGTON STREET IMPROVEMENTS FIRST FUNDING PRIORITY WHEREAS, on July 18, 1994, the City Council was notified of the certification of an advisory initiative measure presented to the City by Peter Newcome, 1577 Rainier Avenue, Petaluma CA 94954; and WHEREAS, at July 18, 1994, the City Council meeting staff reported to the Council the possible impacts of the advisory initiative measure; and WHEREAS, pursuant to Election Code Section 5353 the City Council is taking action to place this initiative on the November 8, 1994, Municipal Election. NOW, THEREFORE, BE IT RESOLVED, ORDERED, AND DECLARED AS FOLLOWS: 1. Pursuant to the requirements of the State of California and the Petaluma City Charter, there is called and ordered to be held in the City of Petaluma, California, on Tuesday, November 8, 1994, a special municipal election for the purpose of obtaining an advisory vote from the voters as to whether or not the City of Petaluma should give first funding priority to improvements to the Washington Street corridor. 2. The City Council pursuant to its right and authority does order submitted to the voters at the special municipal election the following question: ADVISORY VOTE ONLY YES Measure Newcome Initiative Should the Petaluma City Council expend City funds (including those NO controlled by the Redevelopment Agency) for improvements to Washington Street, which ensure Washington Street's ability to adequately accommodate its present and future traffic, before such funds are appropriated, allocated and expended .for construction or improvement of any other street or traffic improvements relating to east/west traffic and before designating projects to Caltrans? 3. The ballots to be used at the election shall be in the form and content as required by law; and, 12es. No..........J.~-2.1..7.... N.C.S. 4. The City Clerk is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to property and lawfully conduct the election; and, 5. The polls for the election shall be open at seven o'clock a.m. of the day of the election and shall remain open continuously from that time until eight o'clock p.m. of the same day when the polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California; and, 6. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections; and, 7. That the notice of the time and place of holding the election is given and the City Clerk is authorized instructed and directed to give further or additional notice of the election, in time, form and manner as required by law. Under the power and authority conferred upon this Council by the Charter of said City.
