HomeMy WebLinkAboutResolution 94-216 08/08/1994 C ' • Resolution No. 94-216 N C.S. of tl~e City of Petaluma, California CALLING AND GIVING NOTICE OF A SPECIAL 1VIiJNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 8, 1994, FOR SUBMISSION TO THE VOTERS OF AN INITIATIVE RESTRICTING EXPENDITURE OF TRANSPORTATION FUNDS AND REQUIRING TWO-THIItDS VOTE TO ESTABLISH RELATED ASSESSMENT DISTRICT WHEREAS, on June 20, 1994, the City Council was notified of the certification of an initiative petition presented to the City by Mark Friedman, for Fulcrum Capital, 7750 College Town Drive, Suite 350, Sacramento, California 95826, Karen D. Greene and Robert E. Greene both of 311 Olympic Court, Petaluma California 94954; and WHEREAS, on June 20, 1994, the City Council requested staff to develop information on the impact of said initiative, to report back, and at the July 18, 1994, City Council meeting staff reported to the Council the possible impacts of the initiative; and WHEREAS, pursuant to Election Code Section 4010 the City Council is taking action to place this initiative on the November 8, 1994, Municipal Election. NOW, THEREFORE, BE IT RESOLVED, ORDERED, AND DECLARED AS FOLLOWS: 1. Pursuant to the requirements of the State of California and the Petaluma City Charter, there is called and ordered to be held in the City of Petaluma, California, on Tuesday, November 8, 1994, a special municipal election for the purpose of determining whether the voters wish to adopt the initiative which would restrict expenditure of transportation funds and require two-thirds vote to establish atransportation-related assessment district. 2. The City Council pursuant to its right and authority does order submitted to the voters at the special municipal election the following question: Measure Fulcrum Capital/Greene Initiative YES Shall the voters of the City of Petaluma adopt an ordina~ice (1) limiting the use of transportation funds NO collected by the City from existing development to improving existing transportation system and (2) requiring two-thirds of the persons owning real property in the proposed assessment district to approve the formation of such a district to fund the transportation project? 3. The ballots to be used at the election shall be in the form and content as required by law; and, Res. No. ..........94.-.2.1.6... w.cs. 4. The City Clerk is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to property and lawfully conduct the election; and, 5. The polls for the election shall be open at seven o'clock a.m. of the day of the election and shall remain open continuously from that time until eight o'clock p.m. of the same day when the polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California; and, 6. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections; and, 7. That the notice of the time and place of holding the election is given and the City Clerk is authorized instructed and directed to give further or additional notice of the election, in time, form and manner as required by law. Under the power and authority conferred upon this Council by the Charter of said City.
