6 RESOLUTION ELECTING TO BE SUBJECT TO THE
7 PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT
8 ONLY WITH RESPECT TO MEMBERS OF THE PETALUMA CITY COUNCIL
9 AND
10 FIXING THE EMPLOYER'S CONTRIBUTION AT AN AMOUNT GREATER THAN OR
11 EQUAL TO THAT PRESCRIBED BY SECTION 22825 OF THE GOVERNMENT CODE
12 SPECIAL DISTRICT

15 WHEREAS Government Code Section 22850.3 provides that a
16 contracting agency may elect upon proper application to
17 participate under the Public Employees' Medical and Hospital Care
18 Act with respect to a recognized employee organization only; and
19

22 WHEAREAS, Government Code Section 22754 (g) defines any
•23 Special District as a contracting agency, and
24

27 WHEREAS, a Special District is hereby defined as a non-
28 profit, self-governed public agency within the State of
29 California, and comprised solely of public employees performing a
30 governmental rather than proprietary function, and
31

34 WHEREAS, the Petaluma City Council hereinafter meeting
35 the above definition; and

39 WHEREAS, the Special District desires to obtain for the
40 members of the Petaluma City Council, who are active and retired
41 employees and survivors of the agency, the benefit of the Act and
42 to accept the liabilities and obligations of an employer under
43 the Act and Regulatations; now, therefore, be it
44

47 RESOLVED, that the Special District elect, and it does
48 hereby elect, to be subject to the provisions of the Act; and be
49 it further

2 RESOLVED, that the employer's contribution for each
3 active or .retired employee or survivor shall be the amount
4 necessary to pay the full cost of his/her enrollment, including
5 the enrollment of family members, in a health benefits plan or
6 plans up to a maximum of $100.00 per month plus administrative
7 fees and. Contingency Reserve Fund assessments; and be it further

11 RESOLVED, that the executive body appoint and direct,
12 and it does hereby appoint and direct, the City Manager to file
13 with the Board of Administration of the Public Employees'
14 Retirement System a verified copy of this Resolution, and to
15 perform on behalf of said Public Agency all functions required of
16 it under the Act and Regulations of the Board of Administration;
17 and be it further

21 RESOLVED, that coverage under the Act be effective,
22 September 1, 1994.
