5 RESOLUTION ELECTING TO BE SUBJECT TO 1'HE
6 PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT
7 ONLY WITH RESPECT TO NON REPRESENTED MISCELLANEOUS
8 EMPLOYEES AND FIXING THE EMPLOYER'S CONTRIBUTION FOR
9 EMPLOYEES AND THE EMPLOYER'S CONTRIBUTION FOR ANNUITANTS AT
10 DIFFERENT AMOUNTS.

14 WHEREAS Government Code Section 22550.3 provides that a contracting
15 agency may elect upon proper application to participate under the Public Employees'
16 Medical and Hospital Care Act with respect to a recognized employee organization

20 WIIEAREAS, Government Code Section 22557 provides that a
21 contracting agency may fix the amount of the employer's contribution for employees
22 and the employer's contribution for annuitants at different amounts provided that the
23 monthly contribution for annuitants shall annually be increased by an amount not less
24 than five percent of the monthly contribution for employees., until such time as the
25 amounts are equal; and

25 WHEREAS, City of Petaluma, hereinafter referred to as Public Agency is
29 a local agency contracting with the Public Employees' Retirement System; and

32 WHEREAS, the Public Agency desires to obtain for the Non Represented
33 Miscellaneous members, who are employees and annuitants of the agency, the benefit
34 of the act and to accept the liabilities and obligations of an employer under the Act and
35 Regulations; now, therefore be it

35 RESOL~IED, that the Public Agency elects, and it does hereby elect to be
39 subject to the provisions of the Act; and be it further

42 RESOI.~IED, that the employer's contribution for each employee shall be
43 the amount necessary to pay the full cost of this enrollment, including the enrollment of
44 his family members m a health benefits plan up to a maximum of $100.00 per month;
45 and be it further

7 RES®LVED, that the employer's contribution for each annuitant shall be
8 the amount necessary to pay the cost of his enrollment, including the enrollment of his
9 family members in a health benefits plan up to a maximum of $5.00 per month; and be
10 it further

13 RESOLVED, that the employer's contribution for each annuitant shall be
14 increased annually by five percent of the monthly contributions for employees., until
15 such tame as the contributions are equal; and that the contributions for employees and
16 annuitants shall be in addition to those amounts contributed by the Public. Agency for
17 administrative fees and to the Contingency Reserve Fund;. and be it further

20 RES®LVED, that the executive body appoint and direct, and it does
21 hereby appoint and direct, the City 11~anager to file with the Board of Administration of
22 the Public Employees' Retirement System a verified copy of this resolution, and to
23 perform on behalf of said Public Agency all functions required of it under the Act and
24 Regulations of the Board of Admimstration; and be it further

27 RES®LVED, that coverage under the Act be effective September 1, 1994.

Under the power and authority conferred upon this Council by the Charter of said City.
