2 RESOLUTION OPPOSING PROPOSITION 188

5 WHEREAS, tobacco use is responsible for the death of over 400,000 people every year
6 and is the number one cause of death in the United States; and
7
8 WHEREAS, Environmental Tobacco Smoke (ETS), or second hand smoke, has been
9 categorized as a cancer causing substance by the Environmental Protection Agency, and
10 exposure to ETS kills an estimated 40,000 persons every year; and
11
12 WHEREAS, the State of California as well as many counties and municipalities conduct
13 aggressive public education campaigns to discourage tobacco use, particularly among children;
14 and
15
16 WHEREAS, the City of Petaluma passed a smoking control ordinance on May 16, 1994
17 which bans smoking, effective September 1, 1994, in all enclosed public places within the City
18 of Petaluma, including but not limited to, all restaurants and all enclosed workspaces, in order to
19 protect people against exposure to ETS; and
20
21 WHEREAS, Proposition 188, mistitled the "California Uniform Tobacco Control Act"
22 would replace the local smoking control ordinance passed in Petaluma and replace it with a state
23 wide law which could permit smoking in every restaurant and workplace in the State; and
24
25 WHEREAS, over 60% of the population of California lives in cities and counties which
26 have tougher tobacco controls than contained in Proposition 188 and would suffer reduced
27 protection from ETS if Proposition 188 passes; and

29 WHEREAS, Proposition 188 is being sponsored by Philip Morris, the largest cigarette
30 manufacturing company in the world, and they do not deny it; and

1 WHEREAS, Proposition 188 prohibits local government from ever passing any tobacco
2 control legislation in the future, and prohibits community organizations from monitoring the
3 illegal sale of cigarettes to minors through tobacco purchase surveys or "sting" operations
4 utilizing minors attempting to purchase tobacco; and

6 WHEREAS, the ventilation standards proposed in Proposition 188 for application to
7 indoor smoking will remove the odor of smoke from the air, but not the cancer causing
8 substances which pose a threat to public health;

10 NOW, THEREFORE, BE IT RESOLVED that the City of Petaluma opposes Proposition
1.1 188 and urges the residents of Petaluma to study the initiative and to vote "NO" on Proposition
12 188.
