HomeMy WebLinkAboutResolution 94-279 10/17/1994 ' F~esolution No. 94-279 N C.S. of the City of Petaluma, California 1 RESOLUTION 2 ADOPTING A NEGATIVE DECLARATION, 3 APPROVING THE CLOSURE AND POSTCLOSURE MAINTENANCE PLANS AND 4 FINANCIAL ASSURANCE MECHANISM, AND AUTHORIZING CITY MANAGER TO 5 IMPLEMENT CLOSURE OF THE CITY OWNED CASA GRANDE LANDFILL 6 7 WHEREAS, the City of Petaluma owns a Class'III.landfill, Facility No. 49-AA-0009 8 situated at the end of Casa Grande Road, Petaluma, California 9 10 WHEREAS, the last waste deposited at the Casa Grande Landfill was in August of 11 1991. 12 13 WHEREAS, Public Resources Code sections 43500 through 43610 .and sections of Title 14 14 of the California Code of Regulations ("Regulations"), Division 7, Chapter 5, Article 3.5, 15 require operators of solid waste landfills to demonstrate the availability of financial resources to 16 conduct closure and postclosure maintenance activities; and 17 18 WHEREAS, sections 18283 and 18290 of the Regulations specify a Pledge of Revenue 19 as an acceptable mechanism to demonstrate financial responsibility for financing postclosure 20 maintenance costs of a solid waste landfill. 21 22 WHEREAS, the City Council on March 1, 1993 authorized the Mayor or City Manager 23 to enter into a Professional Services Agreement with Brown & Caldwell Engineers for 24 preparation of a Closure Plan and Post Closure Maintenance Plan for the Casa Grande Landfill 25 in compliance with .state regulations. 26 27 WHEREAS, the Planning Department reviewed the Closure Plan and Postclosure 28 Maintenance Plan and prepared an Initial Study of potential environmental impacts and provided 29 proper notice in accordance with state and local Guidelines. 30 31 WHEREAS, based upon the Initial Study and comments received it was determined that 32 potential impacts could be avoided and/or mitigated to a level of insignificance by specific 33 mitigation measures attached herein as conditions of approval. 34 35 WHEREAS, there is no substantial evidence that the project, as conditioned, could have 36 a significant effect on the environment. 37 38 WIEIEREAS, a monitoring program is included in the specified mitigation measures to 39 ensure compliance in accordance with state and local guidelines. 40 41 WHEREAS, the Negative Declaration was presented to the City Council and was 42 reviewed and considered along with any comments prior to making a decision on the project. 43 44 WHEREAS, the Closure Plan and Postclosure Maintenance Plan is consistent with the 45 intent, goals, and policies of the Petaluma General Plan and will further protect the environment, 46 public health and general welfare. 47 48 NOW THEREFORE BE IT RESOLVEID, based on the foregoing findings, that the 49 City Council hereby adopts a Mitigated Negative Declaration and approves the Casa Grande 50 Landfill Closure and Postclosure Maintenance Plans incorporating the mitigation measures 51 described in Exhibit A as conditions of approval. 94-279 Hes. N.C.S. t 1 BE IT FURTHER RESOLVED that the City Council hereby authorizes the City 2 Manager to enter into Professional Services Agreement for acquisition, survey, design and 3 engineering services to implement the Closure Plan and other services for postclosure 4 monitoring. 5 6 BE IT FURTHER RESOLVED that the City Council authorizes the City Manager to 7 provide the required security for financial assurance in guaranteeing payment of closure costs 8 through a surety bond and payment of postclosure costs through a pledge of revenues agreement. 9 Under the power and authority conferred upon this Council by the Charter of said City. No........9.4-.2.7.9...... w.cs. } ~ ~ i 1 EXHIBIT A 2 3 CONDITIONS AND MONITORING PROGRAM 4 IN SUPPORT OF A 5 MITIGATED NEGATIVE DECLARATION 6 FOR THE 7 CASA GRANDE LANDFILL CLOSURE PROJECT 8 9 10 1. Sensitive marsh areas shall be clearly marked on the grading plans as areas to be avoided 11 and verified by the Planning Department prior to advertising for bids. 12 13 2. To prevent inadvertent fill within the marsh area, the Contractor shall be required to 14 place a barrier (such as hay bales) along the toe of the slope to capture any loose 15 material. On-site inspection and verification by the Planning Department shall be 16 required prior to issuance of grading permit. 17 18 3. The Contractor shall provide an Erosion Control Plan pursuant to Municipal Code 19 Ordinance 1576 and demonstrate that the Regional Water Quality Board NPDES General 20 Permit Requirements have been met, prior to issuance of grading permit. 21 22 4. The City shall obtain permits if necessary, from the Dept. of Fish and Game and the 23 Army Corps of Engineers for excavation within the drainage channel. Conditions of the 24 permit approval(s) shall be incorporated into the Plans and Specifications for the project 25 and verified by the Planning Department prior to advertising for bids. 26 27 5. If any material falls into the marsh, it shall be removed by the contractor and verified by 28 the Planning Department prior to final acceptance. 29 30 6. Grading areas and temporary haul roads (if any) shall be watered to control dust. At a 31 minimum exposed areas shall be watered twice daily during use and more often as 32 needed during windy or extremely dry periods. These requirements shall be included in 33 the specifications for the project and verified by the Planning Department prior to 34 advertising for bids. The Public Works and Planning Departments shall monitor the site 35 during the construction period to verify compliance 36 37 7. Contractor shall provide to the City the name and phone number of a contact person with 38 authority to implement mitigation measures as necessary and respond to complaints. 39 This shall be verified by the City Public Works Department prior to award of bid. 40 41 42 8. In accordance with the Marsh Enhancement Plan, the following measures shall be 43 incorporated into the plans and specifications for the project and verified by Planning 44 Department prior to advertising for bid. 45 46 a. Enlarge the outlet of the site drainage by breaching the existing berm at two 47 locations as specified in the Marsh Enhancement Plan to improve site drainage 48 through the marsh. Refer to Items #2 from the Petaluma Marsh Enhancement 49 Plan illustrated in Figure 5. DSO 9 ~ r~C; S 1 2 b. Debris (concrete and glass) located beyond the toe of the slope within the Marsh 3 area shall be removed from the marsh area. Refer to Item #9 from the Petaluma 4 Marsh Enhancement Plan as illustrated in Figure 5. 5 6 9. The site shall be reseeded and planted with native plant species after final grading in 7 accordance with the specifications contained in the Marsh Enhancement Plan. Upland 8 areas should be broadcast with a native rye-grass mix. The landfill drainage areas where 9 salinity is low should include plantings of willows, cottonwoods, native rose and native 10 blackberry to provide replacement habitat. Shrubs of Toyon, Coyote Bush and Quail 11 Bush should be planted along the side slopes adjoining the Petaluma Marsh. Refer to 12 Figure 6 for cross-section of landfill slope. These specifications shall be incorporated 13 into the project plans and verified by the Planning Department prior to advertising for 14 bids. 15 16 10. Use of local seed, cuttings and plant stocks collected from the surrounding area shall be 17 required to preserve genetic integrity and ensure plant success. Revegetation may be 18 completed by local volunteer community groups if available immediately following 19 construction or incorporated into the Plans and Specifications for the project, to be 20 verified by the Planning Department, prior to advertising for bids. 21 22 11. Avoid truck hauling on Lakeville Highway by utilizing a temporary haul road. If a 23 temporary haul road is not feasible, limit truck hauling operations on Lakeville Highway 24 to weekdays between 7 a.m. to 4:30 p.m. and weekends between 8 a.m. and 6 p.m. This 25 mitigation shall be included in the Plans and Specifications for the project and verified 26 by the Planning Department prior to advertising for bids. 27 28 12. Contractor shall be required to contain any contaminated water or materials encountered 29 on-site and shall remove, treat and dispose of any contaminated substances in accordance 30 with local, state and federal regulations. This measure shall be incorporated into the 31 Plans and Specifications for the project and verified by the Planning Department prior to 32 .advertising for bids. R Aso q - a~1q ~I C, S
