3 A RESOLUTION APPROVING MODIFICATION OF THE PROPERTY
4 RESTRICTION AGREEMENT AFFECTING 821, 825 AND 829 BANTAM WAY - A
5 PORTION OF A.P. No.019-070-045 (FORMERLY 984 BODEGA AVE. - A PORTION
6 OF A.P. No. 019-070-041) TO ALLOW FOR THE CREATION OF ONE LOT (829
7 BANTAM WAY} WITH LESS THAN 20,000 SQ.FT. IN AREA TO ALLOW
8 SEPARATE SALE OF AN EXISTING DWELLING UNDER THE AFFORDABLE
9 HOUSING REGULATIONS OF THE CITY OF PETALUMA

12 WHEREAS, upon prezoning the property located at 821, 825 and 829 Bantam Way - a
13 portion of A.P. No. 019-070-045 (formerly 984 Bodega Ave. - a portion of A.P. No. 019-070-
14 041) the City Council, pursuant to Ordinance No. 1740 N.C.S., directed the City Manager
15 to enter into a property restriction agreement with the owner(s) of said property
16 prohibiting any future land division into lots less than 20,000 square feet in area to address
17 neighborhood concerns of increased density potential; and

19 WHEREAS, William and Patricia Willitts, the owners of the property located at 821, 825
20 and 829 Bantam Way - a portion of A.P. No. 019-070-045, have applied for a legal
21 subdivision of the subject property, and a revision to the property restriction agreement to
22 allow for the creation of one lot with less than 20,000 square feet of area to allow separate
23 sale of the existing dwelling located at 829 Bantam Way under the affordable housing
24 regulations of the City of Petaluma; and

26 Whereas, the Planning Director has determined that the proposed revision to the property
27 restriction agreement will not result in a potential increase in housing density, and is in
28 conformance with the Petaluma General Plan and Zoning Ordnance;

30 NOW, THEREFORE, BE IT RESOLVED that the City Council of Petaluma hereby
31 authorizes the City Manager to enter into a revised property restriction agreement with the
32 property owner(s) to permit the legal division of the property at 821, 825 and 829 Bantam
