GORDON WHITE OF 4 THE SPARC COMMITTEE APPROVAL OF ARCHITECTURAL, 5 SITE AND LANDSCAPE PLANS FOR A PROPOSED 2,987 SQ. FT. 6 SINGLE-FAMILY RESIDENCE AT 818 BLOSSOM COURT 7 (LOT 3, SOUSA SUBDIVISION, PHASE 2), APN 006-610-020 8 9 WHEREAS, on June 23, 1994, the Site Plan and Architectural Review Committee 10 (SPARC) approved architectural, site and landscape plans for a proposed 2,987 sq. ft. 11 single-family residence at 818 Blossom Ct. APN 006-610-020 filed by Christopher Lynch, on 12 behalf of Kathleen and Stephen Arsenault, and 13 14 WHEREAS, a timely appeal of the SPARC Committee's decision was appropriately filed 15 by Gordon F. White of 752 Paula Lane, stating objection to the action of the SPARC 16 Committee; and 17 18 WHEREAS, the City Council has held a public hearing to consider the appeal and all 19 reports, documentation and testimony submitted on the matter: 20 21 NOW, THEREFORE, BE IT RESOLVED that the City Council finds as follows: 22 23 1. The SPARC Committee acted appropriately in its decision of June 23, 1994. 24 25 2. The proposed project is consistent with the PUD standards for this subdivision and 26 that the architect has diligently worked to reduce impacts to the neighboring lots as 27 required by the conditions of the PUD. 28 29 3. The proposed project conforms to the requirements and intent, goals, and policies 30 of the Petaluma General Plan, by reducing privacy impacts to adjoining residences 31 and avoiding unnecessary site disturbance. 32 33 4. The proposed project, as conditioned, will not constitute a nuisance and will not be 34 detrimental to the public welfare of the community. 35 36 BE IT FURTHER RESOLVED that the City Council hereby determines that the 37 requirements of the California Environmental Quality Act have been adequately addressed 38 in the previously certified EIR approved by Resolution no. 7974 N.C.S. and Reso. 85-50 39 N.C.S., February 19, 1985. 40 Reso. 94-255 NCS 1 Kcs. No . N.C.S. 1 BE IT FURTHER RESOLVED that the City Council hereby affirms the decision of the 2 SPARC Committee .and denies the appeal of Gordon F. White subject to the following 3 conditions: 4 5 Site Specific Conditions: 6 7 1. All requirements of the Chief Building Official shall be complied with, including: 8 9 a. Grading must be certified when completed to indicate compliance with 10 approved plans and will be required for occupancy. 11 b. Certify finished floor elevation before occupancy. 12 c. Elevations over 160' require water holding tank. 13 d. Any holding tank required for elevations above 160 feet must meet 14 Engineering Department design requirements. 15 e. Where ground slopes greater than 1 on 10, foundation shall be stepped per 16 Uniform Building Code 2907(c). 17 f. Soils with expansion index greater than 20 requires special design foundation 18 per Uniform Building Code 2904(b). 19 g. All retaining walls shall meet the requirements of the 1991 UBC, and shall 20 comply with Petaluma Standards Ordinance No. 1727/1988. 21 h. All roofing shall be "B" rated or better per Ordinance No. 1744/ 1988. 22 i. Show site drainage and grading topography. 23 j. Indicate all utilities on site plan. 24 k. Driveway gradient shall comply with Ordinance No. 1533/1982. 25 1. Responsible party to sign plans. 26 m. Submit soils report to verify foundation design and to evaluate site specific 27 subsurface drainage conditions and to recommend practical improvements to 28 reduce subsurface drainage to adjacent properties. 29 n. Plans must show compliance to 1991 UBC, UPC, UMC, and 1990 NEC. 30 Plans must also show compliance to current Title 24 Energy Code. 31 0. Provide structural calculations for all non-conventional design items. 32 p. Third floor of residence will require second exit. Check Section 3303 of the 33 1991 UBC. 34 q. Detail all swales. 35 r. Paula Lane residents have complained about rain run-off onto their property. 36 Drainage pattern should be checked and corrected if necessary before 37 occupancy. 38 39 2. Final grading plan shall be prepared by a Registered Civil Engineer and shall be 40 subject to review by staff to insure compliance with the approved Improvement 41 Standards. Slopes must be included. 42 43 3. Location and screening provisions of holding tank shall be shown on plans and are 44 subject to staff review and approval prior to issuance of building permit. 45 46 4. Fencing shall comply with all provisions of the original and amended Improvement 47 Standards and shall be subject to staff review and approval. All fencing shall be 48 installed or bonded for prior to occupancy. 49 50 5. All applicable conditions of approval for the Sousa Subdivision and Planned Unit 51 Development as adopted by the City Council and Improvement Standards as 52 adopted by SPARC shall remain in full force and effect. This project shall be subject to all applicable development fees, including sewer 3 connection fees, water connection fees, community facilities development fees, park 4 and recreation fees, school fees, and in-lieu housing fees. 5 6 7. A final landscape plan shall be submitted for review and approval by the Planning 7 Director prior to the issuance of the Certificate of Occupancy. Said plan shall 8 include tree and/or shrub planting on the Paula Lane slope. Selection and 9 placement of said planting shall follow from discussion with the immediate 10 neighbors. Landscape improvements shall be installed prior to occupancy of the 11 home. 12 13 Conditions added b~ Cityy Council: 14 15 8. A Civil Engineer and a Soils Engineer shall perform analysis and prepare plans as 16 directed by and subject to review and approval by the Director of Engineering prior 17 to the issuance of a building permit. The engineering consultants shall meet with 18 the Director of Engineering prior to the commencement of their work to discuss the 19 appropriate scope of services. 20 21 9. A Geotechnical Engineer shall, prior to the issuance of a building permit, review the 22 site conditions to determine if the rock lined Swale contributes to subsurface 23 drainage problems. Following the recommendations of the Geotechnical Engineer, 24 the applicant shall convert a portion of the rock lined Swale to concrete prior to 25 occupancy of the home. 26 27 10. The openings to the existing drop inlets shall be reviewed by the Consulting Civil 28 Engineer for adequacy, especially in regard to debris accumulation. The rear part 29 of the swales may have to be raised (enlarged), as determined by the Consulting 30 Civil Engineer, to prevent over-topping in the event that the inlets get plugged. 31 32 11. A Geotechnical Engineer shall submit a recommendation for a french drain system 33 along the lower portion of the property. The french drain shall be designed to 34 accept a subdrain from the upstream property, and be able to tie in a future drain 35 system downstream, if desirable. 36 37 12. The property owner shall be responsible for maintaining swales, ditches, inlets and 38 other on-site drainage improvements in an operable manner. 39 40 Standard SPARC Conditions: 41 42 13. All trees shall be a minimum fifteen gallon size (i.e. trunk diameter of at least 3/4 43 inch measured one foot above- the ground) unless otherwise specified (e.g.: 24" box 44 or specimen size) and double staked; all shrubs shall be five gallon size. All 45 landscaped areas not improved with lawn shall be protected with atwo-inch deep 46 bark mulch as a temporary measure until the ground cover is established. 47 48 14. All plant material shall be served by a City approved automatic underground 49 irrigation system. 50 51 52 53 Reso. 94-255 NCS 3 1 15. All planting shall be maintained in good growing condition. Such maintenance shall 2 include, where appropriate, pruning, mowing, weeding, cleaning of debris and trash, 3 fertilizing and regular watering. Whenever necessary, planting shall be replaced 4 with other plant materials to insure continued compliance with appllcable 5 landscaping requirements. Required irrigation systems shall be fully maintalned in 6 sound operating condition with heads periodically cleaned and replaced when 7 missing to insure continued regular watering of landscape areas, and health and 8 vitality of landscape materials. 9 10 16. Root barrier systems shall be utilized for trees near streets or walkways as needed, 11 subject to staff review and approval. 12 13 17. All improvements and grading shall comply with the Sonoma County Water 14 Agency's Design Criteria. 15 16 18. All work within a public right-of-way requires an excavation permit from the 17 Department of Public Works. 18 19 19. Construction activities shall comply with applicable .Zoning Ordinance and 20 Municipal Code Performance Standards (noise, dust, odor, etc.). 21 22 23 24 app818\dh1 Under the power and authority conferred upon this Council by the Charter of said City.
