2 A RESOLUTION OF THE CITY COUNCIL OF
3 THE CITY OF PETALUMA APPROVING THE ISSUANCE
4 OF A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY
$ FOR A-1 TAXI

7 WHEREAS, Walter Watkins, Daniel Watkins, and Rodney Leight have applied for a
8 Certificate of .Public Convenience and Necessity for A-1 Taxi to operate two taxicabs in
9 Petaluma, and a dispatch office from a private residence at 372 Park Place Drive; and

11 WHEREAS, the proposal was found to be exempt from CEQA Guidelines pursuant to
12 Section 15301 (c), Class 1, which exempts the operation of existing public or private
13 structures and facilities; and

15 WHEREAS, a public hearing was held on 25 October 1994 before the Planning
16 Commission to consider the operation of the taxicab company; and
17
18 WHEREAS, the Planning Commission voted to recommend approval of both the proposed
19 CEQA exemption and the proposed Certificate of Public Convenience and Necessity for A-
20 1 Taxi; and

22 WHEREAS, the request was heard on the 21st day of November 1994 before the City
23 Council at which time information was heard and considered by the Council.

25 NOW, THEREFORE, BE IT RESOLVED that it is ordered and declared that the City
26 has found the taxicab company, A-1 Taxi to be exempt from the requirements of CEQA;
27 and that A-1 Taxi be allowed to operate, based on the following findings and subject to the
28 following conditions:

32 1. The proposed taxi company and dispatch office at 372 Park Place Drive, as
33 conditioned, will conform to the requirements and intent of the Petaluma Municipal
34 Code.

36 2. The proposed taxi company and dispatch office at 372 Park Place Drive, as
37 conditioned, will conform to the requirements and intent, goals, and policies of the
38 Petaluma General Plan.

40 3. The proposed taxi company and dispatch office at 372 Park Place Drive, as
41 conditioned, will not constitute a nuisance or be detrimental to the public welfare of
42 the community.

44 Conditions:

46 1. The certificate may be suspended or revoked for violation of any of the terms of
47 Chapter 14 of the Petaluma Municipal Code, or for violation of any of the terms of
48 the certificate, or for misuse or abuse of the privilege thereby granted pursuant to
49 Chapter 14 of the Petaluma Municipal Code.

51 2. A-1 Taxi shall comply with all applicable provisions of Petaluma Municipal Code
52 Chapter 14 and Petaluma Zoning Ordinance Section 21-202.

1 3. The fare rates as proposed by the applicant are hereby fixed, and may only be
2 changed by City Council action.

4 4. Before operations may commence, all vehicles owned and operated by A-1 Taxi
5 shall be Inspected by the Police Department. Any defects uncovered during the
6 inspection shall be corrected and the vehicles reinspected by the Police Department.

8 5. All drivers of A-1 Taxi vehicles shall obtain a (taxi) driver's license issued through
9 the Central Permit Bureau (Finance Department of the City of Petaluma) before
10 commencement of operations.

12 6. All vehicles owned and operated by A-1 Taxi shall obtain annual vehicle permits
13 issued through the Central Permit Bureau (Finance Department of the Clty of
14 Petaluma) before commencement of operatlons. All permits for taxicabs shall
15 expire annually the thirtieth day of June.

17 7. Before a vehicle permit may be issued., and prior to the operation of any of such
18 vehicles, there shall be filed with the City Clerk a policy of public liability Insurance
19 executed and delivered by a company authorized to carry out any insurance business
20 in the state, the financial responsibility of which company has been approved by the
21 City Manager.

23 8. Any proposal for increase in the number of taxicabs shall be reviewed and approved
24 by the City Council before expansion of service is made.

26 9. A Home Occupation Permit to allow use of 372 Park Place Drive as the dispatch
27 office shall be obtained from the Planning Department before commencement of
28 operations.

30 10. Drivers shall not meet or congregate, nor shall taxis be garaged at 372 Park Place
31 Drive.
