Page 1 Resolution No. 2022-131 N.C.S. of the City of Petaluma, California APPROVING A LOCAL ROAD SAFETY PLAN AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS AND UTILITIES, OR DESIGNEE(S), TO IMPLEMENT THIS PLAN WHEREAS, a Local Roadway Safety Plan (LRSP) creates a framework to systematically identify and analyze safety issues, collaborate with partner agencies and stakeholders, and develop a multidisciplinary toolbox of traffic safety countermeasures, and WHEREAS, the Federal Highway Safety Improvement Program is a grant source for safety improvements and eligibility for grant funding under this program now requires an adopted LRSP, and WHEREAS, the City executed a professional service agreement with GHD, Inc. to produce the LRSP, and WHEREAS, the City engaged with partner agencies and the public in the development of the LRSP, and WHEREAS, the LRSP will serve not only as a requirement for grant fund eligibility but also as a blueprint for addressing traffic safety issues throughout the City across the “5 E’s” of traffic safety disciplines: Engineering, Enforcement, Education, Emergency Response, and Emerging Technologies; and WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378 in approving the City’s LRSP does not meet CEQA's definition of a “project,” because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment; and WHEREAS, the LRSP “does not require the preparation of an EIR [Environmental Impact Report] or negative declaration” under the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15262 as the LRSP involves a planning study for possible future actions that the City has not approved, adopted, or funded, and any future project that results from the LRSP will have its own analysis for compliance with CEQA. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares the above recitals are true and correct and are incorporated into this ordinance as findings of the City Council. 2. Finds that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378 in approving the City’s LRSP does not meet CEQA's definition of a “project,” because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. Moreover, the LRSP “does not require the preparation of an EIR or negative declaration” under the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15262 as the LRSP involves a planning study for possible future actions that the City has not approved. adopted. or funded. Authorizes the Director of Public Works and Utilities, or designee(s), to implement the LRSP. Under the power and authority conferred upon this Council by the Charter of said City.
