HomeMy WebLinkAboutResolution 94-301 11/21/1994 'i ( Resolution No. 94-301 N:C.~,. of the City of Petaluma, California '1 2 ~ 3 APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE 4 ENVIRONMENTAL ENIIANCEMENT AND MITIGATION PROGRAM 5 UNDER THE SECTION 164.56 OF THE STREETS AND 6 HIGHWAYS CODE 1989 FOR THE LAKEVILLE HIGHWAY WIDENING PROJECT 7 8 9 WHEREAS, the Legislature of the State of California has enacted AB471 (Chapter 106 of 10 Statutes of 1989), which provides $10 million annually for a period of 10 years for grant 11 funds to local, state and federal agencies and nonprofit entities for projects to enhance and 12 mitigate the environmental impacts of modified or new public transportation facilities; and 13 14 WHEREAS, the Resources Agency has established the procedures and criteria for 15 reviewing grant proposals and is required to submit to the California Transportation 16 Commission a list of recommended projects from which the grant recipients will be 17 selected; and I 18 19 WHEREAS, said procedures and criteria established by the Resources Agency require the r: 20 a licant to certi b resolution the a royal of a llcatiori before submission of said PP , fY Y PP PP 21 application to the State; and 22 t 23 WHEREAS, the application contains assurances to maintain and operate the property, that 24 the applicant must comply with; and X25 26 WHEREAS, the applicant, if selected, will enter into an agreement with the State of 27 California to carry out the environmental enhancement and mitigation project; 28 29 NOW THEREFORE BE IT RESOLVED that the City Council of the City of Petaluma: 30 31 1. Approves the filing of an application for the Environmental Enhancement and 32 Mitigation Program for grant assistance. 33 34 2. Certifies that said applicant will make adequate provisions for operation and 35 maintenance of the project. 36 37 3. Appoints John Scharer, City Manager as agent of the City of Petaluma, to conduct 38 all negotiations, execute and submit all documents, including, but not limited to 39 applications, agreements, amendments, payment requests and so on, which may be X40 necessary for the completion of the aforementioned project.
