WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162, and other applicable law, City staff solicited bids for the Project; and WHEREAS, the Project was bid on November 5, 2021, and Five (5) bids were received and opened on November 18, 2021, in accordance with applicable law; and WHEREAS, the lowest responsible base bid for the Project was submitted by Coastside Concrete & Construction, Inc. from Santa Rosa, CA, for$440,127.50; and WHEREAS, on November 15, 2021 —The Council adopted Resolution No 2021-188 N.C.S authorizing the City Manager to execute Contracts not to exceed $750,000.00 for site improvements at 900 Hopper Avenue, Petaluma, CA, for the project known as "the People's Village"upon staff review and identification of the lowest bids on November 18, 202; and WHEREAS,the final contract amount, as amended, including all change orders, overruns, and underruns, is $752,000.00 and is within the approved Project budget; and WHEREAS, environmental review for compliance with the California Environmental Quality Act was already performed when the project was awarded; and WHEREAS, at the time of awarding the contract he City found that the proposed action is exempt from the requirements of the California Environmental Quality Act(CEQA) as CEQA does not apply to actions taken by a city which has declared a Shelter Crisis to lease, convey, or encumber city-owned land or to facilitate the lease, conveyance, or encumbrance of city-owned land for or to provide financial assistance to, a homeless shelter constructed or allowed by Government Code Section 8698.4, as This installation of site improvements and equipment is done to mitigate the Shelter Crisis and is exempt pursuant to Government Code Section 8698.4 and pursuant to Section 15269(c) of the CEQA Guidelines,as specific actions necessary to prevent or mitigate an emergency;additionally,the proposed site improvements would be exempt pursuant to CEQA Guidelines Section 15303, as the site improvements constitute minor construction in small; and WHEREAS, accepting the completion of the Project does not constitute a Project pursuant to CEQA Guidelines Section 15378 because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment; and WHEREAS,the FY 21/22 City Budget of$750,000.00 is slightly less than what is needed due to the rise in costs since the project was initially brought forward to Council, and the additional funding has been secured in funding from the County of Sonoma. NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares that the above recitals are to be true and correct and are incorporated into this resolution as findings of the City Council. Resolution No. 2022-151 N.C.S. Accepts as complete the contract titled,Interim Housing Solutions Project Improvement,The Peoples Village, with the final contract amount of $752,000.00 subject to the Contractors continuing warranty and other obligations pursuant to the contract. 4. Authorizes and directs the City Clerk to file a Notice of Completion concerning the Project with the Sonoma County Clerk's office within ten(10) days of the date of this Resolution. 5. Authorizes and directs Staff to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the Project contract, California Public Contract Code Section 7107, and applicable law. Under the power and authority conferred upon this Council by the Charter of said City.
