HomeMy WebLinkAboutResolution 2022-154 N.C.S. 09/19/2022 DocuSign Envelope ID:E5259EB4-04A9-406C-9B49-86701290EB04 Resolution No. 2022-154 N.C.S. of the City of Petaluma, California AUTHORIZING AWARD OF CONTRACT FOR THE PETALUMA TURNING BASIN DREDGING PROJECT TO LIND MARINE, INC. WHEREAS, City staff has prepared construction bid documents and advertised for construction for the Petaluma Turning Basin Dredging Project("Project"); and WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162, and other applicable law, City staff solicited bids for the Project; and WHEREAS, the Project was bid on August 4, 2022, and two (2) bids were received and opened on August 25, 2022, in accordance with applicable law; and WHEREAS, the lowest responsible base bid for the Project was submitted by Lind Marine, Inc. from Petaluma, CA for a base bid of$563,054.58; and WHEREAS,the bid submitted by Lind Marine,Inc.was found by staff to be fair and reasonable, and satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that Lind Marine,Inc.possesses a valid California Contractor's License, Class A (General Engineering Contractor), number 1000690 that qualifies the Contractor to perform the Project; and WHEREAS, the City has received no protests concerning the Lind Marine, Inc. proposal, and the time to protest the proposal has lapsed; and WHEREAS, the project, including the sediment deposition sites, is consistent with the Programmatic EIR/EIS prepared for the Long-Term Management Strategy (LTMS) for Placement of Dredged Material in the San Francisco Bay and the 1998 and 2015 Biological Opinions for the LTMS which specifically identify dredging of the Petaluma Marina and Petaluma River Turning Basin; and WHEREAS, additionally, this project is exempt under CEQA Guidelines Section 15304(g) (Minor Alterations to Land)which exempts"maintenance dredging where the spoil is deposited in a spoil area authorized by all applicable state and federal regulatory agencies" as the dredging of the turning basin will comply with all state and federal regulatory agencies, and CEQA Guidelines Section 15301 (Existing Facilities) which exempts periodic maintenance dredging which involves negligible or no expansion of the existing use. Moreover, there are no cumulative impacts, unusual circumstances, or other factors that would make the exemption inapplicable; and WHEREAS,the FY 22/23 CIP budget will incorporate sufficient funding and appropriations to complete the Project as bid. NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares that the above recitals are to be true and correct and are incorporated into this resolution as findings of the City Council. Resolution No. 2022-154 N.C.S. Approves the project budget for the Petaluma Turning Basin Dredging Project. 4. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162, and other applicable law, waives any and all non-conformance in the bid of Lind Marine, Inc. for the Petaluma Turning Basin Dredging Project,Project No. C 14402010 and finds that Lind Marine, Inc., is the lowest responsible bidder with a base bid of$563,054.58. 5. Awards the contract for the Petaluma Turning Basin Dredging Project, Project No. C14402010 to Lind Marine, Inc., in the amount of$563,054.58,the amount of the lowest responsive bid, conditioned on Lind Marine, Inc.'s timely execution of the Project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 6. Authorizes and directs the City Manager to execute the Project contract on behalf of the City of Petaluma upon timely submission by Lind Marine, Inc., of the signed project contract and all other required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 7. Approves a construction contract contingency of$115,000. Under the power and authority conferred upon this Council by the Charter of said City.
