Resolution No. 2022-155 N.C.S.
of the City of Petaluma, California
AUTHORIZING A PURCHASE FROM SUEZ TREATMENT SOLUTIONS, INC. FOR THE ELLIS
CREEK WATER RECYCLING FACILITY TERTIARY UPGRADE PROJECT
WHEREAS, the City of Petaluma currently operates the Ellis Creek Water Recycling Facility (ECWRF);
and
WHEREAS, the Water Recycling Facility and River Access Improvements Project Final Environmental
Impact Report (EIR), which included the development of the ECWRF (State Clearinghouse #2001052089) was
certified on August 5, 2002,by City Council as Resolution No. 2002-135, with addenda prepared in 2004, 2005,
2006, 2007, twice in 2016; 2022 and
WHEREAS,compliance with the California Environmental Quality Act(CEQA)for the purchase of Aquaray
40 HO Vertical Lamp Generation 2 Modules was previously completed with the previous CEQA documents; and
WHEREAS, the purchase of the items is additionally exempt pursuant to CEQA Guidelines Section 15301
(Existing Facilities) as the Aquaray 40 HO Vertical Lamp Generation 2 Module System will be used to replace
the Generation 1 Modules and the commonsense exemption as the purchase of the Aquaray 40 HO Vertical Lamp
Generation 2 Module System without the installation of the item will not directly or indirectly impact the
environment; and
WHEREAS, the North Bay Water Reuse Authority (NBWRA) Phase 2 Final Environmental Impact
Report/Environmental Impact Statement (State Clearinghouse #2017072051) was certified on August 14, 2018,
by the NBWRA of which the City of Petaluma is a member agency; and
WHEREAS, Section 4.04.050 of the Petaluma Municipal Code allows formal bidding procedures to be
dispensed with when the commodity can be obtained from only one vendor; and
WHEREAS, Resolution No. 2020-064 N.C.S. of the Petaluma City Council made the findings necessary for
sole source procurement of equipment; and
WHEREAS, Suez Treatment Solutions is the sole vendor for the Aquaray 40 HO Vertical Lamp Generation
2 Module; and
WHEREAS, a pre-negotiated price has been proposed by Suez Treatment Solutions, Inc.; and
WHEREAS,there is sufficient funding for the project in Wastewater Enterprise funds.
NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Petaluma hereby:
1. Declares that the above recitals are true and accurate and are incorporated as findings of this Resolution.
2. Finds that compliance with the California Environmental Quality Act (CEQA) for the purchase of Aquaray
40 HO Vertical Lamp Generation 2 Modules was previously completed with the previous CEQA documents.
Specifically, the Water Recycling Facility and River Access Improvements Project Final Environmental
Impact Report (EIR), which included the development of the ECWRF (State Clearinghouse #2001052089)
was certified on August 5,2002,by City Council as Resolution No.2002-135,with addenda prepared in 2004,
2005,2006,2007,twice in 2016;2022.Additionally,the purchase of the items is additionally exempt pursuant

to CEQA Guidelines Section 15301 (Existing Facilities) as the Aquaray 40 HO Vertical Lamp Generation 2
Module System will be used to replace the Generation 1 Modules and the commonsense exemption as the
purchase of the Aquaray 40 HO Vertical Lamp Generation 2 Module System without the installation of the
item will not directly or indirectly impact the environment.
3. Approves the purchase of pre-submittal costs for thirty Aquaray 40 HO Vertical Lamp System, including
lamp modules,power distribution and data center, interconnecting cables, and automatic cleaning system.
4. Finds that the purchase of Aquaray 40 HO Vertical Lamp Generation 2 Module System can only be obtained
from one source and pursuant to Resolution No. 2020-064 N.C.S. and for the reasons stated therein and
attached to the concurrent staff report as attachment 2 and incorporated into this Resolution,the City complied
with the purchasing requirements of the Petaluma Charter and Municipal Code.
5. Authorizes the City Manager, or their designee, to execute any necessary agreements and documents to
complete the purchase of the pre-submittal and related items.
6. Directs staff to file a Notice of Determination with the County Clerk.
Under the power and authority conferred upon this Council by the Charter of said City.
