' 1 of the City of Petaluma, California 2 3 4 A RESOLUTION APPROVING THE ISSUANCE OF A MITIGATED NEGATIVE 5 DECLARATION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY 6 ACT FOIL AMENDMENTS TO THE MEADOW PARK P.U.D. ZONING DISTRICT AND 7 PHASE 1 OF THE UNIT DEVELOPMENT PLAN, A PORTION OF A.P. No's 137-170-32 8 and 137-180-28 9 10 WHEREAS, the Planning Commission has recommended the issuance of a Mitigated 11 Negative Declaration pursuant to the California Environmental Quality Act (CEQA) for 12 the .following: 13 14 1. Amendment to the Meadow Park Office Complex P.U.D. Zoning District to delete 15 bank branches as a "Conditional Use" and add bank branches as a "Principally 16 Permitted Use". 17 18 2. Amendment to Phase 1 of the PUD Unit Development Plan for the Meadow Park 19 Office Complex as shown on plans submitted to the City on October 28, 1992. 20 21 WHEREAS, the City Council finds that the requirements of the. California Environmental 22 Quality Act relating to this project have been satisfied through preparation of focused 23 environmental studies approved by Resolution No. 86-307 N.C.S. on November 17, 1986, 24 and a subsequent initial study of environmental impacts directly related to this project. 25 26 NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative 27 Declaration pursuant to the California Environmental Quality Act is hereby approved, 28 based on the following findings and mitigations: 29 30 Findings: 31 32 1. On the basis of the Initial Study and any comments received that there is no 33 substantial evidence that the P.U.D. amendment as mitigated will have a significant 34 effect on the environment. 35 36 2. An initial study has been conducted by this lead agency, which has evaluated the 37 potential for this P.U.D. amendment to cause an adverse effect -- either individually 38 or cumulatively -- on wildlife resources. For this purpose, wildlife is defined as "all 39 wild animals, birds, plants, fish, amphibians, and related ecological communities, Res. v~.........g31.~1........ ~.cs. f, 1 including the habitat upon which the wildlife depends for its continued viability." 2 (Section 711.2, Fish and Game Code). 3 . 4 3. There is no evidence that the proposed P.U.D. amendment would have any 5 potential for adverse effect on wildlife resources. 6 7 Mitigations 8 9 1. Increased surface water runoff and demand for increased public services from this 10 project shall be mitigated through the requirement to pay special development fees 11 prior to issuance of a building permit and/or issuance of a Certificate of Occupancy. 12 13 2. All exterior light fixtures shall be shown on plans subject to staff review and 14 approval. All lights attached to buildings shall provide a soft "wash" of light against 15 the wall. All lights shall conform to City performance standards (e.g. no direct 16 glare, no poles in excess of 20 feet height, etc.) and shall compliment building 17 architecture. 18 19 3. Visual aesthetics of the temporary bank facility shall be addressed through 20 administrative SPARC review prior to issuance of a building and/or grading permit. 21 Visual aesthetics of the permanent bank facility shall be reviewed by SPARC prior 22 23 24 4. 25 26 27 28 to issuance of a building and/or grading permit.
