HomeMy WebLinkAboutResolution 2022-164 N.C.S. 10/17/2022 DocuSign Envelope ID:2EEOBF9F-4DDE-4807-AAFA-3F2E1C7F442E Resolution No. 2022-164 N.C.S. of the City of Petaluma, California APPROVING PURCHASE OF A VOLTSTACK 30 KW MOBILE BATTERY TRAILER FROM PORTABLE ELECTRIC IN THE AMOUNT OF $165,000 AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO COMPLETE THE PURCHASE WHEREAS,the City of Petaluma successfully received a Public Safety Power Shutoff(PSPS)Mitigation from the California Office of Emergency Services (CalOES) on March 12, 2021 in the amount of$300,000 for specified uses; and WHEREAS,purchase of a mobile energy storage system is an allowable use of the abovementioned grant funds, as determined by CaIOES; and WHEREAS, staff received a quote from Portable Electric for a VOLTstack 30 K mobile energy storage system in the amount of$170,000; and WHEREAS, $96,671.50 shall be used from the CaIOES PSPS Mitigation grant and$73,328.50 from the City Facilities Impact Fee shall be used to purchase the VOLTstack 30 K system; and WHEREAS, Section 4.04.050 of the Petaluma Municipal Code allows dispensing with formal bidding when a commodity can be obtained from only one vendor; and WHEREAS,the VOLTstack 30 K station provides 80 kWh of energy storage and up to 27 kW of nominal power, which is more than any other model and is the only model sufficient to meet the City's needs and specifications; and WHEREAS,Portable Electric is the only company that sells this model; and WHEREAS, as the VOLTstack 30 K trailer-mounted mobile charging station is the only model that can meet the City's requirements and Portable Electric is the only company that sells this model, the purchase of the VOLTstack 30 K system can be sole-source purchased and the City's Charter and Code requirements are satisfied; and WHEREAS, adoption of this Resolution is exempt from the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that purchasing a mobile battery system does not meet CEQA's definition of a "project," because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment,and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. Relatedly, if the proposed action did constitute a project under CEQA the action is exempt under the common-sense exemption, CEQA Guidelines Section 15061(b)(3) as the mobile battery system is expected to be charged at a City facility with electricity from Sonoma Clean Power's EverGreen program, which is associated with negligible greenhouse gas emissions and CEQA Guidelines Section 15301 as the operation of a public mechanical equipment involving negligible or no expansion of use. Finds the above recitals to be true and correct and are incorporated herein as findings of this Resolution. 2. Authorizes the City Manager to execute all documents necessary to complete the purchase of a VOLTstack 30 K mobile energy storage system. 3. Finds that the purchase of the VOLTstack 30 K mobile energy storage system can only be obtained from one source and that the City complied with the purchasing requirements of the Petaluma Charter and Municipal Code. Under the power and authority conferred upon this Council by the Charter of said City.
