Resolution No. 2022-165 N.C.S.
of the City of Petaluma, California
AUTHORIZING A CHANGE ORDER TO THE CONTRACT FOR THE
TURNING BASIN DREDGING& DOCK UPGRADES PROJECT
(PHASE: PETALUMA TURNING BASIN DREDGING PROJECT)
TO INCORPORATE PHASE ONE OF THE MARINA DREDGING PROJECT
WHEREAS, City staff prepared construction bid documents and advertised for construction for the Petaluma
Turning Basin Dredging Project ("Project"); and
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162, and other applicable law, City staff solicited bids for the project; and
WHEREAS, the project was bid on August 4, 2022, and two (2) bids were received and opened on August
25, 2022, in accordance with applicable law; and
WHEREAS,on September 19,2022,the City Council awarded the contract to the lowest responsible bidder,
Lind Marine, Inc. from Petaluma, CA for a base bid of$563,054.58; and
WHEREAS, during pre-construction planning, it was determined that there would be a substantial benefit to
completing an initial phase of dredging at the Marina to provide for public safety improvements and to allow all
Marina users the ability to access the Marina's fueling station, which is now only accessible during the highest
tides; and
WHEREAS,with the additional funding the City is now able to complete an additional phase of the dredging
project which will be the same work and at a virtually contiguous location of the Petaluma River; and
WHEREAS, an initial phase of dredging at the south end of the Marina would allow for the County Sherriff
and the City of Petaluma's Police and Fire boats to dock at the Marina, greatly increasing response times and
improving public safety; and
WHEREAS, maintenance dredging is categorically exempt under the California Environmental Quality Act
("CEQA") and the project, including sediment deposition sites, is consistent with the Programmatic EIR/EIS
prepared for the Long-Term Management Strategy (LTMS) for Placement of Dredged Material in the San
Francisco Bay and the 1998 and 2015 Biological Opinions for the LTMS which specifically identify dredging of
the Petaluma Marina and Petaluma River Turning Basin; and
WHEREAS, the estimate to complete the initial phase of dredging at the Marina is $1,100,000; and
WHEREAS,the FY 22/23 CIP budget will incorporate sufficient funding and appropriations to complete the
contract change order.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby:
1. Declares that the above recitals are to be true and correct and are incorporated into this resolution as findings
of the City Council.

2. Finds this project is categorically exempt under the California Environmental Quality Act("CEQA") and will
not have any cumulative impacts, unusual circumstances, or other factors that would make the exemption
inapplicable;therefore,the project is exempt under Section 15304 (g),"maintenance dredging where the spoil
is deposited in a spoil area authorized by all applicable state and federal regulatory agencies."
3. Approves the project budget for the Change Order to add the preliminary phase of the dredging at the Marina
which is found to be the same project as was awarded on September 19, 2022.
4. Authorizes and directs the City Manager to execute a change order on behalf of the City of Petaluma to add a
preliminary phase of dredging at the Petaluma Marina.
Under the power and authority conferred upon this Council by the Charter of said City.
