HomeMy WebLinkAboutResolution 93-50 03/01/1993Res®lution No. 93-50 N C.S. ~' 1 of the City of Petaluma, California 2 3 4 RESOLUTION AMENDING THE DEVELOPMENT PLAN AND DESIGN 5 GUIDELINES FOR THE JUDITH COURT RESIDENTIAL PUD A 24-LOT 6 DEVELOPMENT (19 SINGLE FAMILY LOTS AND 5 LOTS FOR THE 7 DEVELOPMENT OF DUPLEXES) LOCATED ON THE NORTHWEST HALF OF 8 THE BLOCK ENCOMPASSED BY VALLEJO, JEFFERSON, AND PAYRAN 9 STREETS, APN's 007-104-01, 03 & 04 10 11 12 WHEREAS, by Ordinance No. 1885 N.C.S. dated April 20, 1992, Assessor's Parcel 13 Numbers 007-104-01, 03 & 04 were rezoned from R-C (Compact Residential) to PUD 14 (Planned Unit District) to allow residential development; and 15 16 WHEREAS, by Resolution No. 92-88 N.C.S. dated April 20, 1992, a Development Plan 17 with accompanying Design Guidelines was adopted for this PUD by the City Council in 18 April 20, 1992, for a residential development consisting of nineteen (19) single family 19 homes and five (5) duplexes on 241ots; and 20 21 WHEREAS, application was subsequently made by Richard Lieb, on behalf of Innovative 22 Developers, to amend the PUD Development Plan and Design Guidelines to allow 23 alternate house design, and Design Standards; and 24 25 WHEREAS, the City Council finds that the requirements of the California Environmental 26 Quality Act and the City of Petaluma Environmental Review Guidelines applicable to this 27 project have been satisfied and hereby incorporates by reference the Mitigated Negative 28 Declaration approved by Resolution No. 91-355 N.C.S. dated December 2, 1991; 29 30 NOW, THEREFORE, BE IT RESOLVED that the amended Development Plan and 31 Design Guidelines for the Judith Court Residential PUD are hereby approved pursuant to 32 Section 19A-504 of Zoning Ordinance No. 1072 N.C.S., as amended; and 33 34 BE IT FURTHER RESOLVED that the City Council hereby adopts the findings, stated 35 hereinafter; Res. u~ ............. 1 .. n.cs. 93-50 1 Findings for PUD Amendment: 2 3 1. This plan clearly results in a more desirable use of land and a better physical 4 environment than would be possible under any single zoning district or combination 5 of zoning districts. 6 7 2. The PUD plan is proposed on property which has received prior approval for 8 similar development at similar densities after consideration of environmental 9 studies addressing traffic issues which concluded that the site has a suitable 10 relationship to one (1) or more thoroughfares (Jefferson and Payran Streets); and 11 that the thoroughfares are adequate to carry any additional traffic generated by this 12 and future development of the site. 13 14 3. The plan for the proposed development presents a unified and organized 15 arrangement of buildings and service facilities which are appropriate in relation to 16 adjacent or nearby properties and provisions for adequate landscaping and/or 17 screening is included to insure compatibility. 18 19 4. The natural and scenic qualities of the site are protected, with adequate available 20 public and private spaces designated on the Unit Development Plan. 21 22 5. The development of the subject property, in the manner proposed by the applicant, 23 will not be detrimental to the public welfare, will be in the best interest of the City 24 and will be in keeping with the general intent and spirit of the zoning regulations of 25 the City of Petaluma, with the Petaluma General Plan, and with any applicable 26 Plans adopted by the City. 27 28 BE IT FURTHER RESOLVED that the City Council hereby approves the amended Unit 29 Development Plan and Design Guidelines, subject to the conditions previously adopted 30 and set forth in Resolution 92-88, adopted 4/20/92, and augmented as hereinafter set 31 forth, as follows: Reso. 93-50 NCS 2 1 2 3 4 5 6 7 8 9 10 11 12 Conditions: 1. Plans submitted to SPARC shall be subject to review for conformance with the following: a. Introduce at least one additional single family unit design on a minimum of 25% of the single family lots that includes a detached garage or one that is recessed significantly from the street; similar to the single family units of the currently approved Development Plan. resjud/hg-7 Under the power and authority conferred upon this Council by the Charter of said City.
