STEAGULL,INC. WHEREAS,in accordance with the City of Petaluma Charter and Municipal Code,California Public Contract Code Section 20162, and other applicable laws, City staff prepared construction bid documents and solicited bids for the Payran Lift Station Rehabilitation Project (C66501519) (Project); and WHEREAS,the project was bid on September 3, 2020, and bids were received and opened on September 30, 2020, in accordance with applicable law; and WHEREAS,the lowest responsible bid for the project was submitted by Clyde G. Steagall, Inc. from Loomis, CA., in the amount of$729,078; and WHEREAS, by Resolution No 2020-159 N.C.S. adopted November 2, 2020, the City Council found the bid of$729,078 to be the lowest responsive bid, and awarded the project to Clyde G. Steagall, Inc., conditioned on Clyde G. Steagall, Inc.'s timely executing the project contract and submitting all required documents; and WHEREAS, the following contract change orders (CCO) for the installation of a new corrugated metal roof and backflow preventer concrete slab, cage and insulation; replacement of a submersible transducer;painting and anti-graffiti coating, installation of LED interior lighting, installation of bollards, installation of generator receptacle, installation of intrusion alarms, and modifications of valve vault drainage; and installation of security gates at the entrance driveways affecting the project amount have been approved: Cost Change Order#1 $ 6,352.56 Change Order#2 $ 1,740.00 Change Order#3 $ 26,080.16 Change Order#4 $ 14,710.84 Total Change Orders $ 48,883.56; and WHEREAS, the final contract amount, as amended, including all change orders, overruns, and underruns, is $777,961.56, and is within the approved project budget; and WHEREAS, environmental compliance was already analyzed by the November 2, 2020, Resolution Awarding the Construction Contract,when the City Council found that this project is categorically exempt under the California Environmental Quality Act("CEQA")pursuant to Article 19, Section 15301(c), of Title 14 of the California Code of Regulations ("CEQA Guidelines") because the project consists of repair and maintenance to an existing public facility involving negligible or no expansion of existing or former use. The improvements include replacing the existing sewage pumps, piping and valving within the existing vaults without changing the use of those facilities. Accordingly, there is negligible or no expansion of use beyond what currently exists and there are no cumulative impacts, unusual circumstances, or other factors that would make the exemption inapplicable pursuant to CEQA Guidelines Section 15300.2; and WHEREAS,based on the foregoing, staff recommends acceptance of the project on behalf of the City. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. 2. The contract titled Payran Lift Station Rehabilitation Project (C66501519), with the final contract amount of $777,961.56, is accepted as complete, subject to the contractor's continuing warranty and other obligations pursuant to the contract. 3. Environmental compliance was already analyzed with Resolution Awarding the Construction Contract, November 2,2020,when the City Council found that this project is categorically exempt under the California Environmental Quality Act("CEQA")pursuant to Article 19, Section 15301(c),of Title 14 of the California Code of Regulations ("CEQA Guidelines") because the project consists of repair and maintenance to an existing public facility involving negligible or no expansion of existing or former use. The improvements include replacing the existing sewage pumps,piping and valving within the existing vaults without changing the use of those facilities. A Notice of Exemption was filed in August 2020 with the County of Sonoma for the Project. 4. The City Clerk is hereby authorized and directed to file a Notice of Completion concerning the project with the Sonoma County Clerk's office within ten(10) days of the date of this Resolution. 5. Staff are hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the project contract, California Public Contract Code Section 7107, and applicable law. Under the power and authority conferred upon this Council by the Charter of said City.
