HomeMy WebLinkAboutResolution 93-61 03/15/19931 2 3 4 5 6 7 8 9 10 11 12 13 14 ~es®ll,ltl®rl N®. 93-61 N ~.5. of the City of Petaluma, California A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA APPROVING THE ISSUANCE OF A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR RAINBOW TAXI COMPANY, 186 KELLER STREET, APN 006-363-01 WHEREAS, Rainbow Taxi Company has operated as a taxicab company inside the City of Petaluma from 186 Keller Street; and WHEREAS, Tim Judd, as the new owner of the company, has applied for a Certificate of Public Convenience arid Necessity; and 15 16 WHEREAS, the proposal was found to be exempt from CEQA Guidelines pursuant to 17 Section 15301 (c), Class 1, which exempts the operation of existing public or private 18 structures and facilities; and 19 20 WHEREAS, a public hearing was held on 9 March 1993 before the Planning Commission 21 to consider the operation of the taxicab company; and 22 23 WHEREAS, the Planning Commission voted to recommend approval of the proposed 24 CEQA exemption and the proposed Certificate of Public Convenience and Necessity for 25 Rainbow Taxi; and 26 27 WHEREAS, the request. was heard on 15 March, 1993 before the City Council at which 28 time information was heard and considered by the Council; and 29 30 NOW, THEREFORE, BE IT RESOLVED as follows that it is ordered and declared that 31 the City has found the Rainbow Taxi Company to be exempt from the requirements of 32 CEQA; and that Rainbow Taxi Company be allowed to operate based on the .following 33 findings and subject to the following conditions: 34 35 Findings: 36 1. The proposed taxi company, as conditioned, will conform to the requirements and 37 intent of the Petaluma Municipal Code. 38 Res. N~............93-6.1.... v.cs. 1 2. The proposed taxi company, as conditioned, will conform to the requirements and intent, goals, and policies of the Petaluma General Plan. 3. The proposed taxi company, as conditioned, will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions: 1. This certificate may be suspended or revoked for violation of any of the terms of Chapter 14 of the Petaluma Municipal Code, or for violation of any of the terms of the certificate, or for misuse or abuse of the privilege thereby granted. 2. Rainbow Taxi Company shall comply with all applicable provisions of Petaluma Municipal Code Chapter 14. 3. The fare rates as proposed by the applicant are hereby fixed, and may only be changed by City Council action. 4. All drivers of Rainbow Taxi Company vehicles shall obtain a (taxi) driver's license issued through the Central. Permit Bureau (Finance Department of the City of Petaluma) before commencement of operations. 5. All vehicles owned and operated by Rainbow Taxi Company shall obtain. annual vehicle permits issued through the Central Permit Bureau (Finance Department of the City of Petaluma) before commencement of operations. All permits for taxicabs shall expire annually the thirtieth day of June. 6. Before a vehicle permit may be issued, and prior to the operation of any of such vehicles, there shall be filed with the City Clerk a policy of public liability insurance executed and delivered by a company authorized to carry out any insurance business in the state, the financial responsibility of which company has been approved by the City Manager. 7. Any proposal for increase in the number of taxicabs shall be reviewed and approved by the City Council before expansion of service is made. Reso. 93-61 NCS 2 1 2 3 4 5 6 7 $. The two parking spaces in front of 186 Keller reserved for taxis shall be maintained free of debris.
