'Clty Of Petaluma, on the 19 th - 'day of September 1977
WHEREAS, the Plannirig Commission of the City of Petaluma
filed with the City cOuncil on the 24th day of August, 1977, its
report as set forth in is Resolution No..'z: 33-77 rejecting an
amendment to the - Ordinance No. N,C.S., as amended; and,
WHEREAS, the applicant has filed a letter of appeal on August
31, 1977; and,
WHEREAS, the appeal came on regularly for hearing before the
Council on September. 19,.1977,
NOW, THEREFORE,' BE IT RESOLVED that the Council hereby makes
the . following findings' Of".fact:
1. The appeal of.the applicant was timely filed in
proper JforM, and was properly Corisidered by the
Council.
2. Due and proper. of the hearing was given to
all parties entitled thereto bY'law.
3. Substantial evidende .Was received in the
redord, both in favor of-and in opposition to the
appeal,and,all of said evidnOei was considered
by the Cburidil:
4. Oral testimony in favOr.of.andin opposition to
the appeal was received duxing hearing, and
was considered by the,Couricil,
• BE IT FURTHER RESOLVED that based its consideration of
the voluminous evidence submitted in Council makes
the following further findings of fat, as required by 'Zoning Ordi-
nance .NO, 'I072 § 19-901 through -19 -901.4
a.. The plan for the proposed development clearly results
in a' more desirable use of lar d and a better "physical environment
than would be possible under any single zoning district or com-
bination. of zoning districts.

b. The property has a suitable relationship to two thorough-
fa.r-es, ; namely, .Ely Boulevard and East :Washington Street, and said
thoroughfares are adequate to carry any additional traffic genet-
ated by the development.-
c. The plan for the prop.osed:development presents a unified
and organized arrangement of buildings; and -service' facilities
which are appropriate in. relation to djac.ent or nearby properties
and that adequate 1andscaping and /or screening is included if
necessary to insure..compatibiaity
d. The natural and-scenic qualities of the site are pro-
tected`, with adequate available public -and private, spaces desig-
nated on the Unit Development Plan,.
e. The development of the subject - property, in the manner
will „ r.imental to the public
proposed by the app;licant., wil -1 not be de t
• welfare, Will be in the best interests of the City and will be
in keeping with the, general intent.. and,s:p'irit of the zoning
regulations of the City of Petaluma with the Petaluma General
Plan, and with any applicable Environmental Design Plan adopted
by the City.
BE. IT FURTHER RESOLVED that based upon the above findings,
the applicant's a e al ou,
p'p ought to be and -' acco•rdingly is "Upheld, and
Ordinance No. 12.63 N.C.S. ' 'rezoning the subject real property from
R -6,500 to a P.U.D. ' (Planned Unit Develo:pmen.t) ought to be passed,
and. this Council declares its intent 'to. pass. said ordinance con
si.stent herewith.
