City of Petaluma, on the
WHEREAS, the owner of certain real property in the City of
Petaluma described in Exhibit "A" attached hereto and made a part
hereof has requested a certificate of compliance therefor; and,
WHEREAS, this Council is empowered to approve such a certi-
ficate even though the subject property does not comply with the .
provisions of the Subdivision Map Act or the Petaluma Subdivision
Ordinance provided the applicant complies with certain conditions;
and,
WHEREAS, the Planning Department has made its report,
NOW, THEREFORE, BE IT RESOLVED that. this Council does .
hereby find as follows:
1. The subject property does not comply with the provisions
of the Subdivision Map Act or of the Petaluma Subdivision
Ordinance.
2. Notwithstanding finding No. 1, the public health, safety,
and welfare will be served by issuing a certificate of com-
pliance for the subject property, subject to certain conditions.
BE IT FURTHER RESOLVED that this Council does hereby grant and .
approve the recordation of the certificate of compliance attached .
hereto as Exhibit B for the subject property, subject to the .
conditions stated therein.
BE IT FURTHER RESOLVED that the Planning . .Director be, and
he is hereby, authorized to execute said Certificate of Compliance.
The City Clerk is hereby directed to record said certificate of
cornplinace with the Sonoma County Recorder.

Being the lands described' in the deed from. the County of Sonoma'
recorded in Book ";2368 of Off icial. Records at page 532 Sonoma
County Records, and being more particularly described as follows;
Beginning at a 6" .x. 6. "" concrete monument on the South side of
Lakeville Highway and marking the Northeast. corner of the lands
described in the aforementioned deed; and running thence along
the South ..edge of Lakeville Highway South 84 41' 35" West 598.02
feet to a 6 x 6" concrete monument :marking the Northwest corner ."
of the aforementioned parcel; thence- South 13 14' 25" West 44.24
feet to a point on the North line of the Northwestern Pacific
Railroad right of way and from which point .a 6" x 6" concrete
monument bears South 13 14' " 25" West 3.5.2' feet distant; thence
along the northerly .line of the Northwestern. Pacific Railroad
right of way North 77 Cl` 51" West 469.36 feet to the Southeast
corner of the aforementioned parcel; thence, leaving" said Railroad

of beginning.

CERTIFICATE OF COMPLIANCE - L!ND DIVISION
(Government Code, Section 66499.35 and
local ordinances enacted pursuant thereto)
CITY OF PETALUMA, a California municipal corporation, acting
at the request of ` W.R.Hilligoss and M. Patricia Hilligoss
the owner of the real property herein described, pursuant to Sec -
tion 66499.35 of the State of California Subdivision -I4ap .Act, and
of local ordinances enacted pursuant thereto, hereby certifies
1. That the real property and /or division thereof described
herein complies with the applicable provisions of the Subdivision
Map Act and of local ordinances enacted pursuant thereto; and,
2. That the issuance and recordation of this Certificate of
Compliance has been duly authorized and approved by the City Coun-
• cil of the City of Petaluma by Resolution. No. 8036 N.C.S. and,
3. That any conditions imposed in granting this Certificate
of Compliance have been fulfilled and implemented by the applicant
or applicant's grantee and that no conditions remain to be ful-
filled and implemented.
CAVEAT: Recordation of this instrument does NOT indicate
or imply that the subject property complies in any respect
with the zoning code of the Petaluma City Zoning Ordi-
nance including, but not limited to, requirements of said
code with respect to lot area, street frontage or lot
width.
The real property affected by this action is situated in the
City of Petaluma, County of Sonoma, State of California, and is com-
monly known as Assessor's Parcel(s) No. 5- 050 -18
and is particularly described in Exhibit "A ", attached hereto, and
made a part hereof for all purposes.
