HomeMy WebLinkAboutResolution 2023-004 N.C.S. 01/09/2023 DocuSign Envelope ID:All B06B84-EE7D-422E-AEAB-0A1 8303939E4 Resolution No. 2023-004 N.C.S. of the City of Petaluma, California AUTHORIZING THE PROCUREMENT OF TWO (2)NEW 2023 TOYOTA BZ4X ELECTRIC VEHICLES FROM HENRY CURTIS FORD, AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO COMPLETE THE PURCHASE,AND FINDING THIS ITEM IS NOT A "PROJECT" PURSUANT TO CEQA GUIDELINES SECTION 15378(B)(5)AND 15061(B)(3) WHEREAS, the City of Petaluma has identified a need to replace two (2) Public Works and Utilities pool vehicles that utilize gas, are outdated, and are at the end of their useful lives; and WHEREAS, the City has adopted a Climate Emergency Action Framework establishing a goal for eliminating transportation emissions through the encouragement of and support for non-combustion vehicles; and WHEREAS, the City has identified key strategic initiatives within their goals and priorities to reduce greenhouse gas emissions and minimize the use of fossil fuels; and WHEREAS, the City seeks to determine if there are reasonable low climate pollution alternative emergency vehicles and equipment available suitable for daily police administrative operations and emergency response use; and WHEREAS, the City has identified the Toyota 2023 bZ4X vehicles as suitable all-electric vehicles as replacement vehicles; and WHEREAS, Petaluma Municipal Code Section 4.04.050 provides that"when the commodity can be obtained from one vendor"the City may dispense with the formal and informal bidding procedures stated in Chapter 4.04 of the Petaluma Municipal Code; and WHEREAS, due to significant supply chain impacts and fuel costs caused by the pandemic, the availability of all-electric vehicles is scarce; and WHEREAS, City staff reached out to numerous dealerships, including those on the State Bid, to inquire on the availability and timeline for all-electric vehicles, and currently, there are no available all-electric vehicles available except for Henry Curtis Ford; and WHEREAS, Henry Curtis Ford has agreed to order the two (2)vehicles for the City of Petaluma; and WHEREAS,the City has determined Henry Curtis Ford is the sole source for the Toyota 2023 bZ4X vehicles, which are the only EVs that meet the City's needs and are available within the City's timeframe; and WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378(b)(5), in that purchasing Toyota bZ4X EVs does not meet CEQA's definition of a "project," because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment; Relatedly, if the proposed action did constitute a project under CEQA, the action is exempt under the common-sense exemption, CEQA Guidelines Section 15061(b)(3)as the use of Toyota bZ4X EVs will reduce emissions from an equivalent internal combustion vehicle. Declares that the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Find that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378(b)(5), in that purchasing Toyota bZ4X EVs does not meet CEQA's definition of a "project," because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment,and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. Relatedly, if the proposed action did constitute a project under CEQA, the action is exempt under the common-sense exemption, CEQA Guidelines Section 15061(b)(3) as the use of Toyota bZ4X EVs will reduce emissions from an equivalent internal combustion vehicle. 3. Finds that the City satisfied the purchasing requirements of the City Charter and Chapter 4.04 of the Petaluma Municipal Code as the Toyota bZ4X EV is a sole source commodity that only one vendor sells.Additionally, these vehicles are the only electric vehicles that meet the City's needs and are available within the City's timeframe due to supply chain issues. 4. Approves the purchase of two (2) 2023 Toyota bZ4X EVs from Henry Curtis Ford in the amount of $97,415.00,plus taxes and fees. 5. Authorizes the City Manager, or her designee, to execute any necessary agreements and documents to complete the purchase of the vehicles and related equipment. Under the power and authority conferred upon this Council by the Charter of said City.
