RESOLUTION RATIFYING MEMORANDUM OF UNDERSTANDING EXECUTED BY THE DULY

AUTHORIZED REPRESENTATIVES OF THE CITY OF PETALUMA AND LABORERS' INTER-
NATIONAL UNION OF NORTH AMERICA, LOCAL 139 (PETALUMA) FOR EMPLOYEES IN UNIT 2

WHEREAS, the City, through its ,duly authorized representatives, and the
Laborers' International Union of North America, Local 139, , (Petaluma), through
its duly authorized representatives, have concluded their mutual obligation to
meet and confer in good 'faith' wi'th respect to terms ancl conditions of employment
for employees in Unit 2, in •accordance with the Meyers-Mi 1 ias-Brown Act and the •
City's EmpLoyer-Employee Relations Rules and Regul'ations (Resolution No. 5512 N.C.S.);
and,
WHEREAS, the duly authorized representatives of the City and Laborer's
International Union of North •Amer i)ca , Local 139 (Retaluma) have executed a
Memorandum of Understanding (dated June 19, 1978) , pursUant to Section 15,,Resol ut ion
No 5512 N.C.S. and recoMmend its approval by the City Counci l, and,
WHEREAS, the City Manager, pursuant to Sect iori' 28, C i t y of Petal uma C i t y
Charter, and as the City's Kunicipal Employees' Relations Officer (Resolution
No 5375 N.C.S.) is r,equired.and empowered to make a reCommendat ion- to the City
Council on matters related to eMployees' compensation; and, . •- •
WHEREAS, the City 'Manager has reviewed and concurs with said Memorandum of
Underseanding for Unit 2 and •does recommend that the City Council ratify said
• Memorandum of Understanding, -
NOV, THEREFORE, BE IT RESOLVED that said Memorandum of Understanding, being
• in the best interests of the City,' is ratified and the terms and conditions of
said Memorandum of Understanding (as 'attached) shall be effective July 1, 1978,
through June 30, .1979.

MEMORANDUM OF UNDERSTANDING

And
LABORERS' INTERNATIONAL UNION OF NORTH.` AMERICA LOCAL 139 ( PETALUMA
p City This document represents the C it of Petaluma 's final and complete
Agreement resulting from the 1978 -79 Meet and Confer sessions with
Laborers' International' Union of North America, Local 139 (Petaluma).
Representatives of the, City and Laborers' 139 (Petaluma) acknowledge
that they have f u l f i l l e d their mutual and respective obligations to
Meet and Confer under the Meyers - Mi l ias -Brown Act. As a result, the
parties have come to a mutual understanding which the representatives
of the C i;ty and Laborers' 1 - (Petaluma) , who have, the' approval. of
their members, agree to `recommend for acceptance and approval to
the City Council of the City of Petaluma.
The expressed provisions hereof represent all the changes to be made
., in Unit 2
i n the terms and cond'i t i ons of employment of t he employees'
(Maintenance). Therefore, al l other terms, conditions and provisions
contained in that certain document entitled "Agreement Between the City
of Petaluma and Laborers' International" Union of North America, Local 139 ",
with the effective date of Jul)/ 1, 1975, and subsequent Memorandum of
Understandings signed by Laborers' 139 and the City and ratified by
the -City Council, not changed hereby shall 'remain in full force and effect.
The parties 'affix their signatures as constituting mutual acceptance and
recommendation of this Memorandum of Understanding to become effective
July ,1, 1978; •upon acceptance and approval of the 'Gi >ty Council.

•The parties mutually recommend acceptance of the following items:
ARTICLE 10, Paragraph 1: refer to attached APPENDIX "A ", Hourly
Rate Wage Schedule, effective date: July 1, 1978.
ARTICLE 21, Paragraph 1, to read as follows:
1. Authorized, City observed, paid holidays:
A. The City will designate ten (10) paid, fixed -date holidays
for employees in this unit. Such holidays shall be established
for the City's Fiscal Year as determined by City Council. Resolution.
B. During the Fiscal'' Year 1978 -79, the City will authorize one
(1) paid "Floating Holiday" per employee, which may be taken
by the employee at . a time selected by the employee, subject
to operational requirements and approval as determined by the
City.
ARTICLE 28, Paragraph 1, to read as follows:
1. City of Petaluma Group Medical- Hospital Insurance Program:
The City shall provide for a group medical- hospital insurance
coverage program for City employees in this unit. The City
shall pay, during 1978 -79, the following insurance premium
amounts towards the City group medical - hospital insurance
coverage program:
A. Insurance premium amount of $45.18 per month,
per empl employee coverage; and
B. For employees who maintain dependent (s) coverage,
either:
a. Insurance premium amount of
$24.97. per month, per employee
towards one (1) dependent
coverage for employees who maintain
one dependent coverage; or
b. Insurance premium amount of
$26. per month, per employee,
towards two (2) or more
dependents coverage for
employees who maintain two. (2) or
more dependents coverage.

ARTICLE 28, Paragraph ,2, to read as follows:
2. City of Petaluma Group Term Life Insurance Program:
The City shall provide for a group term life insurance program
for City employees;. i`n Lthis unit. The City . shall pay, during
1978 -79, the insurance premium amount of $2.80 per month,
per employee towards employee, only, coverage for such insurance
in the principle sum of $5,000 per employee.
ARTICLE 28, Paragraph 3, to read as follows:
City Group Program:
3. Cit of Petaluma Grou De ntal Insurance rog :
The City shall provide for a group dental insurance program for
City employees in this unit. The City shall pay, during 1978 -79,
the fol`lowing insurance premium amounts towards the City group .
dental insurance coverage program:
A. Insurance premium amount of $6.86 per month„ per
employee towards employee coverage; and
B. Insurance premium amount of $14.85 per month, per
employee towards dependents coverage for employees
who maintain dependents coverage.
ARTICLE 31, Paragraph 5, to read as follows:
5. The terms of this Agreement shall commence on July 1, 1978, and
continue until the expiration date of June 30, 1979, and from
year to year thereafter unless written notice is given by one
party to the other setting forth a desire to negotiate modifications
to this Agreement as set forth in Paragraph 2,, Article 31.
