RESOLUTION RATIFYING MEMORANDUM OF UNDERSTANDING EXECUTED BY THE DULY
AUTHORIZED REPRESENTATIVES OF THE CITY OF PETALUMA AND THE PETALUMA PEACE
OFFICERS' ASSOCIATION FOR EMPI_OYEES IN UNIT • •

WHEREAS the City 'through its duly authorized representatives, and the
Petaluma Peace Officers' Associati-on through:its duly authorized representatives,
have concl the i r mutual obl igat ion to 'meet and confer in good faith with
respect to terms and conditi'ons of, employment for employees in Unit 6, in -
accordance with the Meyers-Millas Brown Act and the City's Employer-Employee
Relations Rules and Regulations (Resolut No 55 12 I\L.C.S.); and,
WFIEREAS, the duly authorized representatives 'of the City and the Petaluma
'•
Peace Officers' 'Association, have executed a. Memorandum of Understanding (dated
June 26, 1978) pursuant .to Section 15, Resolution No. 5512, N.C.S. and recommend
i ts approval by the City CouRc i 1 ; ind
WHEREAS, the City Manager„ pursuant to Section 28, City of Petaluma City
• Charter, and as the City's Municipal Employees. Rel'ations Officer (Resolution No. 5375 '
• N.C.S.) is requi and empowered to make a recommendation to the City Council on
matters related to employees' compensation; and,
WHEREAS, the City Manager has reviewed and concurs with said Memorandum •
• of Understanding for Unit 6, and does recommend that the City Council ratify
said Memorandum of Understaniling.
NOW, THEREFORE, BE IT RESOLVED that said Memorandum of Understanding, being
in the best interests of the City, is ratified and the terms and conditions of
said Memorandum of Understan'ding (as attached) shall be effective July I, 1978,
through June 30, 1979..
under the power and authority conferred upon this Council by the Charter of said City..

MEMORANDUM OF UNDERSTANDING
Between
THE CITY OF PETALUMA.
And
PETALUMA PEACE OFFICERS' ASSOCIATION
Representatives of the Ci;ty'of Petaluma and the Petaluma Peace Officers' Asso-
ciation acknowledge that they have fulfilled their mutual and respective ob l i ga-
- Lions to meet and confer Under the Meyers- Milias Brown Act relative to employees
in Unit #6. As a result, have come to a mutual understanding which
the representatives of the City of` Petaluma and the representatives of the
Petaluma Peace Officers' Association, who have the approval of their members,
' agree to recommend for acceptance and approval to the C i t Y Council of the City
of. Petaluma, as follows:
1. This Memorandum of Understanding shall be for.-. a one (1) year term
for the fiscal year`commencing;Ju 1y 1, .1.978, through June 30, 1979•
2. The expressed provisions hereof represent all the changes to be
made in the terms and .conditions of .employment of the:empl oyees
of the City of Petaluma represented by'the Petaluma Peace Officers'
Association and constitute the City employees in Unit ' 6,. , Therefore,
all other terms, conditions and provisions not changed hereby shall
remain in full force effect,
3t; The parties will commence meeting and conferring for 1979-80 fiscal
year not later than the end of April, 1979,, and will endeavor to
reach an agreement, in a written Memorandum of Understanding for
submission to the City Council '.for its determination, prior to
the adoption by the C i t y y of its Final Budget for the subsequent
Fiscal Year.
4. The City shall increase on July 1, 1978, , the existing salary
ranges for each of the classifications included in representational
Unit 6 by five percent , (5%)
5. The City °of Petal uma Group Medical-Hospital and Dental Insurance Program:
The City shall provide for a ,group:. medical-hospital and dental
insurance coverage ;program for .City employees in this unit.
The City shall pay, during fiscal year 1978 79, the following
insurance .premium amounts towards the ,City group medical-hospital
insurance coverage 'program: .`

B. For 'employees who maintain dependent(s) coverage, either:
1. Insurance premium amount of $21.68 per month,
per employee, towards one (1) 'dependent '
coverage for employees Who :;;maintain one .

The City shall pay, during fiscal year-1978 the fol'lowing insurance ,

towards employee cov.erag:e, and
B Insurance - premium amount of $14.85 per month, per employee; "

6. Uniform/Clothing Allowance Program:
All employees shall comply with the uniform/clothing requirements and -
proced°ur>es as,establ i shed and .administered by the Police Chief'.
The Uniform/Clothing
form /Cloth ing Al lowance Program shall be paid in fiscal year
1978- 79, with one-"half of the .annual amount to be paid. on or before •
' September 5, . 1978, and the other half to be paid on or before March 5,. '
1979, for those employees in the following classifications: -.'
A. The amount of $200..00 per employee,: per year for the classi•fi'cations. ,
of Police Officer, Police Officer (Investigator), Youth Services - -
' Off 'jeer, Pol; ice Sergeant and 'Pol ice Sergeant (Invest igator). '
' B. The amount ,of $120.00 per employee, per year for the 'class' i f i cat ions-
of - Parking, Enforcement Officer, ..Animal Control Officer, and Assistant
Animal' Control Officer.
Employees ,hired on or after August. 31 , - 1978, and prior to March 1, 1 979, •
_ shall be paid a full annual payment_ amount on or before. March 5, 1979, :
Employees 'h _red on or after February 28;1979, and prior to June 30, 1979,
shall be paid a full annual payment amours =t on or before June 30, 1979:. ,
An employ'ee' who terminates from City service or is released - from City
service shall only receive a prorata annual'. amount: An employee who'
so separates from City service after any. payment .has: been made shall .,,
return that portion of the allowance determfined by the last :day itn
City service 'and' the end of the fiscal year. Any employee on "leave • -. ,.
of 'absence f without pay or leave status in excess of thirty, • (30) calendar
days. shall receive ;a prorata amount for -the fiscal year. - -
7. . A work week shall consist of forty "(40)' hours "worked in'one week, based upon a
• . fifty - two , '.(52) week. year An on-duty work -. day may consist of eight (8), hours per day

24 - hour days. The City solely determines and administers all requlrements,
practices' and procedures, related to, for example', _ schedu l ing.,. rescheduling,
shifts, :wa t,ches-, assignments, holidays and other matters related thereto..
For purposes of evaluation and adaptability to the department as determined

by the Pol ice Chief, for 1978 •
` _ ( "a) . 'Poi ice Officers in 't patrol division will be placed onto -
a beginning four 4) oten (10) hour c ork day for an eva luation period
August 6, 197 thr on or .about June 30, 1979.
• (b') further, Poli Sergeants in the patrol division may, be -
pl,aced onto a four (4) ten (10) .hour 'work day` `for an
` evaluation period as determined by the Police Chief:

8: The City will provide one (1) "Floating Holiday" ofr eight hours per
employee, during fiscal year 1978 -79, which: may be by the
employee at a time .:mutually agreed upon~ by the employee, and the
Police Chief, consistent with operational need's..
9' The Police Educational Incentive 'Pay Program for 1,978 -7 is set
forth in 'Appendix "A ", attached' hereto and ma a part hereof.
The parties affix their .signatures as constituting mutual acceptance and
recommendation of this Memorandum of Understanding to become effective
July 1, 1978

APPENDIX "A' • •
POLICE EDUCATIONAL INCENTIVE PAY PROGRAM
A. This Program encourages employees in specific classifications to •
acquire and to maintain educational achievement. •
•
B. Educational incentive pay is provided for qual if ied •employees
the classification and for the amount as *specified below:
•
1. Police Officer, Police Officer (Investigator) or Youth -
Services Officer:

Advanced P.O.S.T. Certificate $75.00 per month, per employee
C. Program Requirements:
Qualification in the Program is determined by the combibattion, of
• attaining and maintaining education and experience in law enforcement.
1. An employee receiving incentive bay on June 30, 1978,
•shall have •such payments continue through Decernber 31;- 1978, ,
2. An employee who is at or above, his/her classification's
salary step III and has received prior to June 30, 1978, ,
an AA Degree in Police Science, or Intermediate F.0,S.5.
Certificate or Advanced P,O.S.T. Certificate shall qualify •
to receive incentive pay (pursuant to B, above)" for the •
period July 1,1978, to December 31, 1978. An employee •
who qualifies between •the period of July 1, 1978,•to
December 31, 1978, shall receive such payment commencing—
with the next full pay period following such qualification •
through December 31, 1978.
3. An employee who meets both of the following reguirernents •
• shall receive incentive pay (pursuant to B, above) for the* _ -
period January 1, 1979, to June 30, 1979:
(a) I the employee is at, or above, his/her claSsifica- •
tion's salary step III, AND • - - ' • - •

(b) the employee has either:
(1) Successfully 'comp three (3)
semester approved college units
during the calendar year 1978, OR
(11) is enrolled in a three (3) semester
approved college unit course, wh ich .
commenced with the Fall semester. of
1978, provided that such course is
successfully completed at the
conclusion of the Semester.
An employee who reaches for the first time, salary step III
of his/her : cl assI f i cat ion, between the period of January 1,
1979, to June 3'0, 1=979=, and who has an AA Degree in Police
Science, or Intermediate ;P.O Certificate or. Advanced
P. O.S.T. Certificate, shall qualify °_to rece_ive incentive
pay (pursuant to B, 'abov commencing.with the next full
pay period following such qualification through June 30, 1979.
4. The following criteria shall apply to the three (3) semester
approved college unit retention requirement, as provided 'i in
3 (b) above:
(a) Courses shall be approved prior to registration,
(b) Courses must be •related : to the ,performance of an
eligible employee !'s :normal duties -and responsi-
bilities as determined by a Comm?ittee, consisting of
the Pol ice Chief, Personnel Officer and a represen-
tative designated by the President of the Association.
5. Proof or verification by the Personnel Officer 'of any
degree or certificate; or attainment: at, or above,
salary step III; or successful completion of three
- (3) semester approved college units is required

6. An employee qualified for more than one payment shall
receive only the higher payment amount.-
D. Any, exceptions to these procedures shall, require the prior approval of
the City Manager.
