HomeMy WebLinkAboutResolution 93-118 05/03/1993j ~f Resolution No. ~~~ ~ R N C.S. 1 of the City of Petaluma, California 2 A RESOLUTION OF THE CITY COUNCIL OF 3 THE CITY OF PETALUMA APPROVING THE ISSUANCE 4 OF A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY 5 FOR JONGARIS, INC. dba YELLOW CHECKER CAB 6 7 8 WHEREAS, William and Patricia Voulgaris have applied for a Certificate of Public 9 Convenience and Necessity for Jongaris, Inc. dba Yellow Checker Cab to operate two 10 taxicabs in Petaluma; and 11 12 WHEREAS, the proposal was found to be exempt from CEQA Guidelines pursuant to 13 Section 15301 (c), Class 1, which exempts the operation of existing public or private 14 structures and facilities; and 15 16 WHEREAS, a public hearing was held on 13 April 1993 before the Planning Commission 17 to consider the operation of the taxicab company; and 18 19 WHEREAS, the Planning Commission voted to recommend approval of both the proposed 2G CEQA exemption and the proposed Certificate of Fublic Convenience and Necessity for 21 Jongaris, Inc. dba Yellow Checker Cab; and 22 23 WHEREAS, the request was heard on the 3rd day of May, 1993 before the City Council at 24 which time information was heard and considered by the Council. 25 26 NOW, THEREFORE, BE IT RESOLVED that it is ordered and declared that the City 27 has found the taxicab company, Jongaris, Inc. dba Yellow Checker Cab to be exempt from 28 the requirements of CEQA; and that Jongaris, Inc. dba Yellow Checker Cab be allowed to 29 operate, based on the following findings and subject to the following conditions: 30 31 Findin s 32 33 1. The proposed taxi company, as conditioned, will conform to the requirements and 34 intent of the Petaluma Municipal Code. 35 36 2. The proposed taxi company, as conditioned, will conform to the requirements and 37 intent, goals, and policies of the Petaluma General Plan. 38 ,z~s. v~........93.-1.1..$..... n.cs. 1 ~, r 1 3. The proposed taxi company, as conditioned, will not constitute a nuisance or be 2 detrimental to the public welfare of the community. 3 4 Conditions: 5 6 1. The certificate may be suspended or revoked for violation of any of the terms of 7 Chapter 14 of the Petaluma Municipal Code, or for violation of any of the terms of 8 the certificate, or for misuse or abuse of the privilege thereby granted. 9 10 2. Jongaris, Inc. dba Yellow Checker Cab shall comply with all applicable provisions of 11 Petaluma Municipal Code Chapter 14. 12 13 3. The fare rates as proposed by the applicant are hereby fixed, and may only be 14 changed by City Council action. 15 16 4. Before operations may commence, all vehicles owned and operated by Jongaris, Inc. 17 dba Yellow Checker Cab shall be inspected by the Police Department. Any defects 18 uncovered during the inspection shall be corrected and the vehicles reinspected by 19 the Police Department. 20 21 5. All drivers of Yellow Checker Cab vehicles shall obtain a (taxi) driver's license 22 issued through the Central Permit Bureau (Finance Department of the City of 23 Petaluma) before commencement of operations. 24 25 6. All vehicles owned and operated by Jongaris Inc., dba Yellow Checker Cab shall 26 obtain annual vehicle permits issued through the Central Permit Bureau (Finance 27 Department of the City of Petaluma) before commencement of operations. All 28 permits for taxicabs shall expire annually the thirtieth day of June. 29 30 7. Before a vehicle permit may be issued, and prior to the operation of any of such 31 vehicles, there shall be filed with the City Clerk a policy of public liability insurance 32 executed and delivered by a company authorized to carry out any insurance business 33 in the state, the financial responsibility of which company has been approved by the 34 City Manager. 35 2 Reso. 93-118 NCS r 1 2 8. Any proposal for increase in the number of taxicabs shall be reviewed and approved by the City Council before expansion of service is made. 3 4 5 6 yccreso/jkt7 Under the power and authority conferred upon this Council by the_ Charter of said City.
