4 RESOLUTION AMENDING FENCING REQUIREMENTS (CONDITION #6) OF
5 RESOLUTION No. 89-36 N.C.S. WHICH APPROVED THE
6 CHERRYWOOD TENTATIVE SUBDIVISION MAP,
7 A.P. No.'s 006-011-68 through 73

11 WHEREAS, by Resolution No. 89-36 N.C.S. dated February 6, 1989, a Tentative
12 Subdivision Map was approved for the Cherrywood Subdivision, a six (6) lot residential
13 project within an R-1 6,500 zoning district; and,
14
15 WHEREAS, application was subsequently made by Michael Bianucci on behalf of MLB
16 Construction, Inc., to amend Condition #6 of Resolution No. 89-36 N.C.S. to permit an
17 alternate type of fencing to be used in the subdivision; and,
18
19 WHEREAS, following a public hearing on April 13, 1993, the Planning Commission
20 recommended approval of the amendment to Condition #6; and.,

22 WHEREAS, the City Council finds that the project is exempt from the requirements of the
23 California Environmental Quality Act (CEQA) pursuant to Section 15061 because the
24 requested amendment will not have a significant effect on the environment.

26 NOW, THEREFORE, BE IT RESOLVED that the amendment to Condition #6 of the
27 Cherrywood Subdivision Tentative Subdivision Map is hereby approved pursuant to
28 Section 6-100 of the Zoning Ordinance No. 1072 N.C.S., as amended.

30 BE IT FURTHER RESOLVED that the City Council hereby adopts the finding and
31 condition of the Planning Commission as its finding and condition, stated hereinafter;

33 Finding for the amendment to Condition #6 of Resolution No. 89-36 N.C.S.:
34 1. The amendment to condition #6 of Resolution No. 89-36 N.C.S. does not constitute
35 a significant change to the Cherrywood Tentative Subdivision Map and/or
36 remaining conditions of its approval.

1 Condition for the amendment to Condition #6 of Resolution No. 89-36 N.C.S.:
2 Revised wording of Condition #6 shall be as follows:

4 To preserve views and/or privacy, decorative fencing (solid and/or open i.e. post
5 and wire) and/or landscaping shall be provided around the project site perimeter
6 and between private lots, location and design subject to staff review and approval.
7 Perimeter fencing shall be installed . by the developer at the time public
8 improvements are constructed. Private lot fencing shall be installed as part of the
9 development of each individual lot prior to issuance of a Certificate of Occupancy.
