HomeMy WebLinkAboutHCPC Resolution 2018-05 06/12/2018 RESOLUTION 2018-05 CITY OF PETALUMA HISTORIC AND CULTURAL PRESERVATION COMMITTEE MAKING A FINDING OF NO SIGNIFICANCE AND AUTHORIZING DEMOLITION OF THE BAY BRIDGE GARAGE LOCATED AT 1 C STREET (APN #: 008-069-002) File No. PLMA-18-0003 WHEREAS, property owner, Kevin Buckler,submitted a request for Historic and Cultural Preservation Committee approval to demolish the existing commercial building located at 1 C Street, Assessor's Parcel No. 008-069-002; and WHEREAS, the applicant submitted a historic resource evaluation titled, Historic Report 1 C Street, Bay Bridge Garage, Petaluma, Sonoma County, CA prepared by Diana J. Painter, PhD, Painter Preservation on March 7, 2016, incorporated herein by reference; and WHEREAS, the proposed demolition is subject to Implementing Zoning Ordinance (IZO) §15.060 and City Council Resolution 2017-122 N.C.S. (Demo Policy); and WHEREAS, the project was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be Categorically Exempt pursuant to Section 15301 (Existing Facilities) and, furthermore, that the exception to the use of a Categorical Exemption at CEQA Guidelines §15300.2(f) does not apply because the structure to be demolished has no cultural or historical significance; and WHEREAS, a staff report dated June 12, 2018 described and analyzed the request and historic evaluation for the Historic and Cultural Preservation Committee; and WHEREAS, Demolition Request was reviewed by the Historic and Cultural Preservation Committee at a duly noticed public hearing on June 12, 2018 in accordance with the City of Petaluma Implementing Zoning Ordinance; and NOW THEREFORE, BE IT RESOLVED BY THE HISTORIC AND CULTURAL PRESERVATION COMMITTTEE OF THE CITY OF PETALUMA AS FOLLOWS: 1. The foregoing recitals are true and correct and incorporated herein by reference. 2. Based on its review of the entire record herein, the Historic and Cultural Preservation Committee makes the following findings: a) The subject building is not located in a designated historic district and is not listed in nor is it eligible for listing on a local, state, or national register or survey; b) The subject building does not represent or convey important architectural, visual, or cultural features that are important in preserving the character of an existing neighborhood. c) The subject building is not associated with events that have made a significant contribution to the broad patterns of local or regional history,or the cultural heritage of California or the United States. As noted in the historic resource evaluation,the "Historic Context-PG&E in Petaluma" established the history of power generation in Petaluma with a special emphasis on the history of this use in the vicinity of D and 1st Streets, which began with the establishment of a gas plant in 1863 and Historic&Cultural Preservation Committee Resolution No.2018-05 Page 1 I continued with the development of a PG&E substation here between 1906 and 1911, by which time the substation building, substation, transmission tower, and a gas holder tank had been constructed.This Period of Significance represents the establishment of this substation,which is still in place with the exception of the gas holder tank.The garage (i.e., subject property) was built in 1937 as a garage and service center. It was built later and as an ancillary use, rather than a use central to the substation. PG&E sold the property in 1964. The historic resource evaluation goes on to note at "Historic Context - Petaluma's Riverfront Warehouse Area" the history of the Riverfront Warehouse Area, referred to in the 2003 Central Petaluma Specific Plan as a potential Riverfront Warehouse Historic District. The subject building, located within the Turning Basin sub-area of the study area, was identified as a potential historic property and as a potential contributor to the historic district. However, significant demolition took place in the Riverfront Warehouse Area, beginning immediately after the plan was adopted. The critical mass of warehouse and mill properties that would have enabled a district to be formed is no longer extant in the west end of the district. With respect to the subject building, it was not developed as a warehouse. It was built later than the prevailing early twentieth century buildings that populated the original Warehouse Area, and it has a different form and orientation than the warehouses,which were oriented to both the river and the railroad tracks. It does share a similar construction method, materials, and workmanship as the warehouses, and this should inform the redevelopment of the site within the context that remains from earlier eras. d) The subject building is not associated with the lives of persons important to local, California, or national history. Research provided in the historic resource evaluation did not reveal a connection between the lives of persons important to local, California, or national history and this building within either historic context mentioned above. e) The subject building does not embody characteristics of a type, period, region, or method of construction, or represent the work of a master, or possess high artistic values. The building at 1 C Street does not represent the distinctive characteristics of a type, period, region, or method of construction, and does not represent the work of a master or possess high artistic values. The building is not representative of the prevailing building types - the warehouses and mills-that once occupied this area.While it shares timber frame construction and corrugated metal cladding with the other buildings in the area, it does not have the same form, orientation or use as the riverfront warehouses and mills. It does not directly relate as a type to either the PG&E context or the Riverfront Warehouses context described in the Department of Parks and Recreation forms within the historic resource evaluation. I f) The subject building has not yielded, nor does it have the potential to yield, information important to the prehistory or history of the local area California or the nation. i This criterion is typically applied to archaeological resources and is not relevant to this evaluation. i 3. Approval is granted by the Historic and Cultural Preservation Committee to demolish the building, located at 1 C street (APN 008-069-002), consistent with the requirements of the Building Code, and as indicated at attached Exhibit 1.A. 2. This approval expressly excludes the demolition or removal of any feature east of the building footprint; namely, the 'Wood Flood Wall' along the Petaluma River and identified in broader development application for a new commercial building. 3. This approval shall not become effective until and unless review under the California Environmental Quality Act (CEQA) for the broader development application for a new commercial building concludes with a determination the demolition activity does not result in a substantial adverse change in the significance of a historic resource. 4. Nothing in this action precludes the imposition of additional conditions of approval related to the pending Conditional Use Permit and Site Plan and Architectural Review application for a new commercial building at this site. Moreover, nothing in this action prevents the imposition of mitigation measures under CEQA whether they relate to demolition activities or not. 5. Prior to demolition commencing, permits shall be issued by the Petaluma Building Division, Bay Area Air Quality Management District (BAAQMD) or other regulatory agencies. Evidence of BAAQMD approval shall be provided prior to building permit issuance. 6. Prior to issuance of a demolition permit, the applicant shall submit for staff review and approval, a written statement describing how building materials, fixtures, doors, and other items of historic nature shall be salvaged, to the extent possible, for reuse or to be made available (at the applicant's expense) to interested parties (pursuant to IZO §15.060(A)). 7. Hours for demolition activities are limited to 8:00 a.m. to 5:00 p.m. Monday through Friday and Saturday from 9:00 a.m. to 5:00 p.m. Construction is prohibited on Sundays and all holidays observed by the City of Petaluma. 8. The applicant shall defend, indemnify, and hold harmless the City or any of its boards, commissions, agents, officers, and employees from any claim, action or proceeding against the City,its boards, commission, agents, officers, or employees to attack, set aside, void, or annul, the approval of the project when such claim or action is brought within the time period provided for in applicable State and/or local statutes. The City shall promptly notify the applicants of any such claim, action, or proceeding. The City shall coordinate in the defense. Nothing contained in this condition shall prohibit the City from participating in a defense of any claim, action, or proceeding if the City bears its own attorney's fees and costs, and the City defends the action in good faith.
