DENYING A REQUEST FOR 1994 ALLOCATIONS
WHEREAS, the City Council has adopted a growth management system by Ordinance
1716 N.C.S. (Chapter 17.26 of the Petaluma Municipal Code) establishing the procedure
for granting or denying allocations on a yearly basis; and
WHEREAS, interested developers have filed Notice of Intent to Develop forms in
accordance with the provisions of Chapter 17.26 and these, in combination with other
allocation obligations created and anticipated by the action of the City Council, comprise
the total number of allocation requests for 1994; and
WHEREAS, the City Council finds the award and/or denial of allocations is not a project
pursuant to Section 1578 of California Environmental Quality Act and, therefore, no
environmental action is necessary at this time.

18 NOW, THEREFORE, BE IT RESOLVED that the City Council denies 1994 allocations
19 to Lakeville Equities (a California Limited Partnership) who requested 100 allocations and
20 reservations for an additional 253 allocations over the next three years fora 22.50 acre
21 .parcel located at the southwesterly corner of Lakeville Highway and Casa Grande Road
22 (APN 005-040-18).

24 BE IT FURTHER RESOLVED that the City Council makes the following findings in
25 support of its denial of these 1994 allocations:

27 Findings:
28 1. The General Plan Land Use Map designates the subject site as "Industrial".
29 Therefore, granting allocations to this site would be inconsistent with the underlying
30 land use principles of the General Plan.

32 2. There are other sites designated for higher density dwellings that are closer to
33 existing shopping and other commodities and within areas developed so that the
34 residential use would be more compatible with its surroundings.

36 3. Consideration of a General Plan land use amendment to permit residential uses in
37 an industrial corridor raises significant issues in terms of future development

.1 patterns, use and intensity of industrial lands, economic foundation of the City at
2 General Plan build-out, jobs-housing balance, and other principles that should be
3 decided before allocations are granted.

5 4. Denial of allocations does not preclude the applicant from proceeding with applying
6 for environmental review and/or General Plan amendment through City processes.
