HomeMy WebLinkAboutResolution 93-150 06/21/1993a resolution No. 93-150 N,C,S. of the City of Petaluma, California 1 2 3 4 5 6 7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA TO 8 IMPOSE A 24-HOUR BAN ON FIREWORKS AND ALCOFIOL IN LUCCI~ESI 9 PARK ON JULY 4, 1993 10 11 12 13 14 15 WHEREAS, the Fourth of July fireworks display at Lucchesi Park is a popular 16 annual City event, drawing large numbers of citizens; and 17 18 WHEREAS, through the providing of the annual fireworks display, the City of 19 Petaluma gives citizens an opportunity to celebrate the 4th of July in a safe and 20 controlled environment; and 21 22 WHEREAS, through the enactment of a temporary ban of fireworks and alcoholic 23 beverages in Lucchesi Park during the 1991/ 1992 Fourth of July celebrations, families 24 were able to enjoy the fireworks display in a safe and friendly atmosphere; and 25 26 WHEREAS, Petaluma Municipal Code section 1.04.01O.K provides for the 27 enactment of a temporary or special law in the form of a resolution which shall 28 constitute a law of the City; and 29 30 WHEREAS, Petaluma Municipal Code section 1.12.010 provides that persons 31 authorized to enforce municipal ordinances, including those defined in Petaluma 32 Municipal Code section 1.04.010.x, may arrest or issue citations for violation of said 33 ordinances or other law. 34 35 NOW, THEREFORE, LET IT BE RESOLVED THAT the City Council of the 36 City of Petaluma, do hereby authorize aone-day ban of fireworks and alcoholic 37 beverages in Lucchesi Park from 1:00 a.m. July 4, 1993 until 8:00 a.m. July 5, 1993; and Res. N.cs. ~` r 1 ` :2 BE IT' FURTHER RESOLVED THAT violation of this resolution shall constitute 3 an unlawful act in a-city park, which act shall be an infraction subject to a fine upon 4 conviction of not less than ten dollars ($10.00) nor more than one hundred dollars 5 ($10b.00) for a first offense.; not less than twenty-five dollars ($25.00) nor snore than two 6 hundred dollars ($200.00) for a second offense; and not less than fifty dollars ($50.00) 7 nor more than five hundred dollars (.$500.00) for a third and subsequent offense 8 committed during the period of time covered by this temporary special law.
