No. 6-092-17, and more particularly described as follows:' That certain piece or parcel of land l,yin.g and bei;i g in the City of Petaluma;, County of Sonoma, State of California, and more partic,ularly described as follows: BEING a portion of the northerly side of Lot 'Five. hundred Seventy- three ('573) as the same is laid down and numbered upon the offi- cial niap of,t'h.e City of Petal`unia, asmade by ]as. RESOLVED that it a is -hereby ordered that the charges stated in said report shall be -assessed against .said real property ,and it -is :her- by confirmed 4s an: assessment against the same and the same shall be recorded :on the. assessment toll, and thereafter said assessment shallcons -tote a special assessment against and be a lien upon .the real prop�e,rty. BE IT FURTHER ;'RESOLVED -that the Director. of Public Works, by and through the 'Chief Building Irrs'pector, is hereby ordered to record a notice of lien in proper legal form against said real property, in the form set out.in Exh-b-i't C attached hereto, and 0 the same shall have the same priorities and bear interest at the rate of 7 percent per annum from -the date of this resolution. Members of the City Council. In accordance with 'the Uniform Buildin.g.Code and - the 'Uniform Code for the Abatement of. Dangerous Buildings, and pursuant to orders to demolish, dated May 26, 19.77, and 'December' 1 , 1978., the structure located upon . the property known.as 719 Petaluma Blvd. `North, (A:P.A'6-092-,17')' was demolished on Febru- ary 8, 1979, at 'a -cost of $2,900 (Two thousand nine hundred dollars). The demolition was performed by 'BUZZ" Millerick, the lowest bidder on the work, pursuant to a lump -sum bi:d. Previously, due and proper Notice was served'upo:n Mrs.. Marian Noles, 313 Fifth Street, Petaluma, California, owner of the structure, -and upon Eugene Kilbride, 1613 E. Madison Street, Petaluma; California, holder of an obli- gation of sale thereon. Mrs. Nole,s exercised her' righ°t of appeal and after a hearing thereon, the Board of B'uil,din.g Appeals upheld, the order to demolish or repair. Mr. Kilbride. declined to e;xerci,se hi';s r°ight to appeal. None of the persons interested in the property complied with the order to demolish or repair. Northbay Savings and:'Loan Association, holder of a first deed of trust upon the ,property, has `express l'y waived any ri gh;t i t' may have had to notice or appeal of th'e de.mo.l ition order, and has- a'cknowhedged first priority of the City's_lien: Based upon the foregoi n.g, I hereby regues.t that -the Counci 1 order and notice ° a " hearing and conduct .the same pursuant to law, in order' to consider written protests and objections to the charges thereon.
