HomeMy WebLinkAboutResolution 93-200 07/19/1993- Resolution No. 93-200 N ~.5. 1 of the City of Petaluma, California 2 3 4 5 6 7 RESOLUTION ADOPTING A NEGATIVE DECLARATION AND APPROVING 8 AMENDMENT TO THE GENERAL PLAN LAND USE DESIGNATION FOR TIE 9 GATTI AND ADJACENT PROPERTIES, AP NO.'S 137-060-85, 10 137-070-11 AND 137-070-24 11 12 WHEREAS, the City Council adopted the Corona/Ely Specific Plan by Resolution No. 89- 13 124 N.C.S. on May 1, 1989, establishing land use designations on the property within the 14 Specific Plan area; and 15 16 WHEREAS, the Gatti property, APN 137-070-24, and adjacent properties, APN's 137-070- 17 .11 (portion) and 137-060-85, are within the boundaries of the Corona/Ely Specific Plan 18 area; and 19 20 WHEREAS, the property owners of these parcels have requested to amend the land use 21 designation of their property; and 22 23 WHEREAS, an initial study was prepared and the results of the study indicate that the 24 proposed amendment will not cause any significant adverse environmental impacts; and 25 26 WHEREAS, the Music, Parks and Recreation Commission considered the request at a 27 public meeting on June 15, 1993 and recommended approval as reflected on Exhibit AA; 28 and 29 30 WHEREAS, the Planning Commission held a duly noticed public hearing at its regular 31 meeting of June 22, 1993, and considered the potential environmental impacts and all 32 written and verbal communication regarding the matter, prior to making their 33 recommendations for the project; and 34 35 WHEREAS, the City Council held a public hearing on the amendment at its meeting of 36 July 19, .1993 and considered all written and verbal communications pertaining to the 37 matter before rendering its decision. 38 93-200 1 Res. N.C.S. 1 NOW, THEREFORE, BE IT RESOLVED that adoption of a Negative Declaration 2 pursuant to the provisions of the California Environmental Quality Act (CEQA) is hereby 3 approved, based upon the following findings and subject to the mitigation measure: 4 5 Findings for Negative Declaration: 6 1. An Initial Study has been prepared and proper notice provided in accordance with 7 the California Environmental Quality Act and local guidelines. 8 9 2. Based upon the Initial Study and comments received, there is no substantial 10 evidence that the project would have a significant effect on the environment. 11 12 Mitigation Measure: 13 1. The relocation of the retail site and the proposed intersection of Sonoma Mountain 14 Parkway/Reisling Road will require the installation of a traffic signal and 15 intersection improvements. The applicant shall be responsible for the design and 16 installation of all necessary intersection and signal improvements. The timing of 17 said design and installation shall be determined in conjunction with future 18 development applications for the property. 19 20 BE IT FURTHER RESOLVED that the Petaluma City Council hereby approves the 21 proposed amendment to the General Plan Land Use Map to change the land use 22 designations as generally reflected on Exhibit AA to include an Urban High designated 23 area of between six and seven acres, based upon the following findings: 24 25 Findin s 26 1. The proposed amendment is deemed to be in the public interest. 27 28 2. The proposed General Plan amendment is consistent and compatible with the rest 29 of the General Plan and any implementation programs that maybe affected. 30 31 3. The potential impacts of the proposed amendment have been assessed and have 32 been determined not to be detrimental to the public health, safety, or welfare. 33 34 4. The proposed amendment has been processed in accordance wit the applicable 35 provisions of the California Government Code and the California Environmental 36 Quality Act (CEQA). 37 Reso. 93-200 NCS 2 1 5.
