MEMORANDUM OF UNDERSTANDING
Between
THE CITY OF PETALUMA
And
PETALUMA PEACE OFFICER`S' 'ASSOC'IATION
Representatives of the City of Petaluma and the Petaluma Peace Officers'
Association acknowledge that they have fulfilled their mutual and respec-
ti`ve obligations to meet ;and confer under the Meyers-Mi1 tas-Brown Act
relative to employees, in Unit #6. As a result;, the pa.rties.have come to
a mutual understanding which the representatives of the City of Petaluma
and the representatives of.the Petaluma Peace Officers' Association., who
have the approval of'the'i°r members, agree to recommend for acceptance and
approval to the City Council of the City of'Petaluma, as follows:
1. This Memorandum,of.Un'derstandi.ng shall be for. a one (1) year
term for the f'.scal year commencing July 1, 197.9, through
June 30, 1980.
2. The expressed provisions hereof .represent all the changes to be
made in the terms,and.conditions of employment of the employees
of the City of .Petaluma represented by the Petaluma Peace Officers'
Association and co.nst'tute:_th;e City employees"iIn Unit #6. There-
fore, all other terms.,: conditions' andprov:is.o'ns not changed hereby
shall remain in fuTl force and effect. -
3. The parties will. commence meeting and conferring for' -198.0-81
fiscal year not later than, the end of AP, HI I 1980, and will
endeavor to reach'an agreement, in a written'Memora`ridum of Under-
standing for subm,ssio'n to the City Council for its determination,
prior to the ad'opt,ion,by the City of its F tna.1 Budget for the
subsequent Fiscal Year.
4. For the purpose of computing the wages of Communications
Dispatcher -Clerk -for the -year 1979-80,, they will be presumed
to'earn the same rate'of pay ais Parking Enforcement Officers.
It is the intention of the, pa.rti=es that the, various wage steps
of Communications Dispatcher -Clerk pos;.iti`o_n in 1979-80 be equal
to the respective steps of ;Parkin,'Enforcement Off icer.
5. The City shall increase. on July 1., 1979, the existing salary
ranges for each of the classifications, included in representational
Unit #6, as follows:,
A) Police Officer and Sergeant 9%
b) Non sworn classi'ficati:ons 8%

6. The City of Petaluma Group Medical -`H'ospi'tals and Dental Insurance
Program: -
The City shall p:rovi;de for a group media _hospital and
dental insurance .cov,era_ge program 'for City employees i n
this unit.
The City shall pay,, during fiscal year 1979-80, the
following insurance premium amounts towards the City
group medical-hospita'1 insurance coverage. program!.
A. Insurance premium ,,amount of $45.18 per fahth;,
per employee, towards employee coverage:; and.
B. For employees who maintain dependent(s.) coverage.,
either:
1. Insurance; premt;um ;amount'of $21.68 per month„
per empl•oyee;, 'towards.. one (,1) depende_nt
coverage for empl,gyees who maintain one
(1) dependent coverage or
2. Insurance premium amount of $30.31 per month:,
per employee, towards two (.2) o.r more dependents
coverage for employees who maintain, tvao' '(2), -or
more dependents, coverage.
C. If, during the ,course; of fiscal year 1979 80.,• the
premium cost be increased, the City shall ':pay the
increase.
The City shall -pay,; during, fiscal year 19;19-80;, .$21.85
toward the City group dental insurance coverage 'pro.gram.
7. Uniform/Clothing Allowance. Program:
All employees shall comply with the uniform/clot6i.n;g requirements
and procedures as.estab`lai:shed and administered by the Police Chief.
The Uniform/Clothing Al`lo.wance Program shall be paid -in fiscal year
1979-80, with one.-half.of'the annual amount to 'be.'paid on or before
September 5, 19.7,,9, .and the ,other. half to be paid on or before March 5,
1980, for those ,employees, i,n the fol l owing cl assi f irca.ti ons
A., The amount of $225_00 ;per employee, per year for the
cla,ssifi.catf ns of Pol ice Off-i°cer, Police Officer
(Tnve'sti,gator), Youth Services Officer, Police
Sergeant and Police Sergeant (Investigator).
B: The amount° of $140.00 per employee,.. per year for the
cl a,ss7f ,catiohs of Parking Enforcement Officer, Animal
Control :Officer, Assistant Animal .Control Officer, :and
Community Service Officer.

Employees =hired on',or .after August '31 1979;; and prior to March 1 ,
1980, shall be paid a full annual payment amount on or before
March 5, 1980. Employees hired on or after February 28, 1980, and
prior to June•30, 1.98:0,; shall be paid a full annual payment amount
on or before June 30,1980.
An employee who terminates from.Ci.ty service or is released from
City service shal"i only, rece;ive'a'prorata annual amount. An
employee who so separates from City service after "any payment
has been made shall return.that portion of the allowance determined
by the last day In•City service and the end of the fiscal year.
Any employee on leave of ,absence without pay or leave.status in
excess of thirty (30) calendar days shall receive a prorata amount
for the fiscal year.,,.
8. A work week shall consist of forty (40) hours worked in one week,
based upon a fifty-two (5Z) week year. An on -duty work day may
consist of eight (8) hours per day in each of five.(5) 24-hour
days or, ten ("10°) hours per day in each of four (4) 24-hour days.
The City solely d'etermi;nes and admini'sters.=all requirements,
practices and procedures, related to, for example, scheduling,
rescheduling, shifts, watches, assignments, holidays and other
matters related thereto.
For purposes of evaluation and adaptability to the department, as
determined by the Police Chief, for 1979-80:
(a) Police Officers in the patrol division will
be placed onto a four (4) ten (l0).hour work
day for an;, evaluation period beginning on
July 1:, 1979:, through to about June 30, 1980.
(b) further, Police Sergeants in the patrol
division maybe 'placed onto a four (4)
ten (1Q) hour -work day for an evaluation
period as determined by the Police Chief.
9. The City will provide. one (1) "floating, holiday" of eight (8)
hours per employee, ,per fiscal' year fo,r employees ass.igned to
work eight (8) hou rs- per day, whi°ch may be:taken by the employee
at a time, mutually agreed upon, by the employee and the Police Chief
consistent with operational .needs.:
The City will .provide one (1.) "floati;ng, holiday" of ten (10) hours
per employee per fiscal year'for employees- assigned to work ten (10)
hours per day, which may be taken by `the employee at a time mutually
agreed, -upon by the employee and the ,Police Chief consistent with
operational needs.
The appropriate hours, eight (8) or ten (10),, will be determined by
the hours per day being u�orked at the-time,the "floating holiday" is taken.

10. The City shall pay .dur-ing fiscal ;year 197'9=80, ,the monthly premium for
the PORAC Long -Term D'isabil Tty plan for al Police Officers and Sergeants;
provided, however, that the total amount,_paid'by the City in connection
with LTD shall not -exceed $17.00 per. month for any employee.
11. The Police Educ'at'ional Incentive Pay Program fdr 1979-80, is set forth
in Appendix "A", -attached hereto and made a part hereof.
12. It is understood that the sick leave proVis=dn of the Memorandum of
Understanding for this unit provides for accrual at the rate of eight (8)
hours per employee per month.,
13. A comprehensive'Memorandum of Understanding to be prepared by the City
Attorney on or before September 15, 1979, to be approved by the parties.
14. Compensatory time off:
An employee may receive, in lieu of being; paid for overtime, compensatory
time off ata mutually agreeable time 'between the City and the employee.
Such compensatory time off may be accrued up to a maximum of thirty (30)
hours for those.emp.loyees in sworn classifications and twenty-four (24)
hours for those employees, in non sworn classifications. Amounts earned
in excess of that will, be paid. Such compensatory time off shall be
used for personal activities only. In the event that the. Fair Labor
Standards Act is fou nd.to apply to the publicector, the above shall then
be administered with the provisions of the Fair :Labor Standards Act.
The parties affix their signatures as constituting mutual acceptance and recom-
mendation of this Memorandum of Understanding to become effective July 1, 1979:

APPENDIX "A"
POLICE EDUCATIONAL INCENTIVE. PAY 'PROGRAM
A. This Program encourages employees in specifi•.c classifications to acquire
and to maintain educational achievement.
B. Educational incentive;pay is provided for qualified employees in the
classification and for the amount as specified below:
1. Police Officer, Police Officer (Investigator) or Youth
Services Officer:
Educational Achievement Incentive Pay Amount
Associate of Arts (AA) Degree in $25..00 per'month, per employee
Police Science
Intermediate P.O.S.T. .Certificate $50.00 per month; per employee
Advanced P.O.S.T. Certificate $75.00 per month, per employee
2. Police Sergeant or Police Sergeant (Investigator):
Advanced P.O.S.T. Certificate $75.00 per month, per employee
C. Program Requirements:
Qualification in the Program is determined, by the combi,,nation of attaining '
and maintaining educat ton and experience in law enforcement.
1. An employee receiving 'incentive pay on.June 30, 1979, shall
have such payments 'continue through 'December 31, 1979.
2. An employee Who is at.,.. or above, h .s/her classif.ication's salary
step III an'd has reteiVed prior to June. 30, 197419, an AA Degree
in Police Science.; or Intermediate P.,O.S.T. Certificate or
Advanced P 0 S`T. certificate shall' qualify to. receive incentive
pay (pursuant to B,, aibove) for the period July 1, 19.79,, to
December 31, 1979. An employee who qualified between -the
period of July 1, 1979, to December 31, 1979, shall receive
such payment commencing with the next full pay period following
such qualification through December 31, 1979.
3. An employee who..,meets both of the following requirements shall
receive incentive pay (pursuant to B, above) for the period
.January 1 , 1980, to June 30, 1980:
(a)' the employee is at, or above, his/her classification's
alary step III, AND
(b) the employee has either:
(I), Successfully completed three (3) semester
approved college units during the calendar
year 1979, OR

approvedcold ege unit course;, which
commenced with th'e'Fal1 'semester'of
1980, provided, that such course: i s
successfully completed at the 'con-

An employee who'reaches, for the first time, salary step III
of his/her c1assification, between the period of January 1,
1980, to June 30, 1980, and who ha -s an 'AA Degree in Police
Science, or Intermediate P.O.S.T. Certificate or Advanced
P.O.S.T C &ti'f-icate, shall qualify to receive incentive
pay (pursuant to, B, above) commencing wi'th the next full
pay period fo'l'lowing such qualification ;through' June 30, 1980.
4. The following eriteria.s.hall apply to.the three (3) semester
approved college unit retention requirement, as provided in
3 (b) above:
(a) Courses shall. be approved prior to registration.
(b) Courses must be related to the performance of an
eligible employee's normal duties and responsibilities
as determined ,by a Committee, consist.i.ng; of the Police
Chief, Personnel Officer and a.representative designated
by the President of the Association.
5. Proof or verification by the Personnel Off.i'cer of any degree
or certificate; or- ttainment at, or above, salary. step III;
or successful completion of three (3) semester approved
college units, i s required 1 n order to, receive or to retain any
educational'.incenti�v,o pay amount.
6. An employee quali.fi,ed for more than one payment shall receive
only the higher payment;".amount.
D. Any exceptions to these procedures shall requitre the prior approval of the
City Manager.
