HomeMy WebLinkAboutResolution 93-201 07/19/1993~~S®IL.ltl®11 Nom. 93-201 N C.S. 1 of the City of Petaluma, California 2 3 RESOLUTION ADOPTING A NEGATIVE DECLARATION AND APPROVING 4 AMENDMENT TO THE GENERAL PLAN LAND USE DESIGNATION FOR THE 5 WISTERIA SUBDIVISION AFFORDABLE HOUSING SITE, 6 AP NO'S. 137-060-85 (PTN) AND 137-070-11 (PTN) 7 8 WHEREAS, a 4 + acre portion of the Graystone Creek Subdivision in the Corona Ely 9 Specific Plan Area has been dedicated to the City of Petaluma by McBail Company for 10 development of affordable housing; and 11 12 WHEREAS, the City Council, in accordance with adopted residential development 13 objectives as specified under Resolution 91-299, has directed that the site be developed as 14 a 30 to 40 unit manufactured home subdivision for moderate-income first time 15 homebuyers, known as Wisteria. Subdivision; and 16 17 WHEREAS, in order to implement the City's adopted residential development objectives 18 pertaining to the Wisteria Subdivision site, application for Amendment to the General Plan 19 land use designation is required and has been filed; and 20 21 WHEREAS, an initial study was prepared an the results of the study indicate that the 22 proposed Amendment will not cause any significant adverse environmental impacts; and 23 24 WHEREAS, the Planning Commission held a duly noticed public hearing at its regular 25 meeting of June 22, 1993, and considered the potential environmental impacts and all 26 written and verbal communication regarding the matter, prior to making their 27 recommendations for the project; and 28 29 WHEREAS, the City Council held a public hearing on the Amendment at its. meeting of 30 July 19, 1993 and considered all written and verbal communications pertaining to the 31 matter before rendering its decision; 32 33 NOW, THEREFORE, BE IT RESOLVED that adoption of a Negative Declaration 34 pursuant to the provisions of the California Environmental Quality Act (CEQA) is hereby 35 approved, based upon the following findings: 36 37 Findings for Negative Declaration: 38 39 1. Based upon the Initial Study and comments received, there is no substantial evidence that the project would have a significant effect on the environment. BE IT FURTHER RESOLVED that the Petaluma City Council hereby approves the proposed Amendment to the General Plan Land Use Map to change the land use designation for the Wisteria site from Urban High and Retail Center to Urban Diversified, based upon the following findings: Findings for General Plan Amendment: 1. The proposed amendment is deemed to be in the public interest. 2. The proposed General Plan amendment is consistent and compatible with the rest of the General Plan and any implementation programs that may be affected. 3. The potential impacts of the proposed amendment have been assessed and have been determined not to be detnmental to the public health, safety, or welfare. 4. The proposed amendment has been processed in accordance with the applicable provisions of the California Government Code and the California Environmental Quality Act (CEQA). 5. The proposed amendment promotes the goals, policies and programs of the City's Housing Element through provision of a City-owned site suitable for development of a 30 to 40 unit manufactured home subdivlslon for moderate-income first time homebuyers. 6. The proposed amendment is consistent with, and implements the City Council's direction as expressed in resolution No. 91-299 N.C.S. as well as the City's adopted Residential Development Objectives. wistresl/tp4 Under the power and authority conferred upon this Council by the Charter of said City.
