URBAN STANDARD TO URBAN DIVERSIFIED, A 8 ZONING MAP AMENDMENT FROM R-I 6,500 (ONE FAMILY RESIDENTIAL 9 DISTRICT) TO SINGLE FAMILY PLANNED UNIT DISTRICT (PUD), A SINGLE 10 FAMILY PUD DEVELOPMENT PLAN, AND TENTATIVE SUBDIVISION 1VIAP TO 11 CREATE FOURTEEN (14) SINGLE FAMILY RESIDENTIAL LOTS FOR TI~iE 12 I~INGSFIELD SUBDIVISION, 729 &731 NORTH WEBSTER STREET, APNs 006-441-23, 13 24 & 006-371-20 14 15 16 WHEREAS, the Planning Commission has considered at a public hearing held June 22, 17 1993 and recommended the adoption of a Mitigated Negative Declaration pursuant to the 18 California Environmental Quality Act (CEQA) and City Environmental Review 19 Guidelines in conjunction with the following actions: 20 21 1. Approval of a General Plan Land Use Map Amendment from Urban Standard to 22 Urban Diversified to allow the development of residential units at an approximate 23 density of seven (7) units per acre. 24 25 2. Approval of a Zoning Map Amendment from R-1 6,500 to PUD to permit the 26 creation of fourteen (14) single family lots with an average lot size of 4,700 sq.ft. 27 28 3. Conditional approval of a Single Family PUD for the development of 13 new single 29 family homes and the restoration of an existing home. 30 31 3. Conditional approval of the Kingsfield Tentative Subdivision Map creating 14 single 32 family lots. 33 34 NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council, in reference to 35 the impacts and mitigations identified in the initial study and as reflected in the 36 Commission's recommendations hereby adopt a Mitigated Negative Declaration for said 37 project based on the following findings, and subject to the following mitigation measures: 38 39 Findings for a Mitigated Negative Declaration: 40 41 1. An Initial Study has been prepared and proper notice provided in accordance with 42 CEQA and local guidelines. 43 93-202 1 Res. No . .............................. N.C.S. 2. Based upon the Initial Study and comments received, potential impacts could be avoided or reduced. to a level of insignificance b~ mitigation measures attached as conditions of approval. There is no substantial evidence that the project, as mitigated, will have a significant effect on the environment. 3. A monitoring program has been included with the mitigations, where applicable, to ensure compliance with the adopted mitigation measures. 4. The project does not have potential to affect wildlife resources as defined in the Fish and Game code, either individually or cumulatively and is exempt from Fish and Game filing fees because there is no evidence that the proposed project would have any potential for adverse effect on wildlife resources. Mitigation Measures: 1. During the construction of Phases 1 and 2 of this project, all grading and erosion control shall conform to the City's Erosion Control Ordinance 15.76. 2. In the event that archaeological remains are encountered during grading, work shall be halted temporarily and a qualified archaeologist shall be consulted for evaluation of the artifacts and to recommend future action. The local Indian community shall also be notified and consulted in the event any archaeological remains are uncovered. 3. The project proponent shall acquire and dedicate to the City the additional right-of- way and sidewalk easement from the property owners at 727 and 729 N. Webster Street necessary to accommodate the new public street extension, subject to staff review and approval prior to Final Map approval. 4. The project proponent shall acquire and dedicate to the City the .necessary storm drainage easement across the adjacent parcel currently owned by the First Baptist Church of Petaluma, APN 006-371-02, subject to staff review and approval prior to Final Map approval. 5. Grading plans shall, to all extent possible, maintain a maximum fill of 2 feet above the existing grade for the detached garages and rear yard space on Lots 1 through 7. Any increases in fill over 2 feet in this area will require the Planning Director's review and approval, and may be subject to additional administrative conditions of the site and/or building design. 6. The finish pad elevation changes between Lots 11 and 12, and 12 and 13 shall not exceed 2 feet. Any increases in fill over 2 feet between these lots will require the Planning Director's review and approval, and may be subject to additional administrative conditions of the site and/or building design. 7. To offset the cumulative impacts this project is projected to create on the City's services, the project proponent shall pay the following Special Development Fees which are imposed on all like construction in the City of Petaluma: Sewer and Water Connection, Community Facilities Development, Storm Drainage Impact, Park and Recreation Land Improvements, School Facilities, In-Lieu Contributions for Provision of Very Low, Low and Moderate Income Housing, and Traffic Mitigation. 8. Positive lot drainage to Kingsfield Court shall be provided for Lots 8 through 14. Reso. 93-202 NCS 2 9. All storm drainage improvements proposed by this development shall conform to the City and Sonoma County Water Agency requirements and the Petaluma Master Drainage Plan. 10. If positive lot drainage cannot be obtained then all backyard drainage control shall be within an underground pipe system with surface catchment swales and inlets. A private storm drain maintenance agreement between lots served by this system shall be submitted in a recordable form. This agreement shall also specify timing of maintenance and be in a form acceptable to the City staff, and recorded concurrent with the Final Map. 11. Construction activities shall comply with applicable Zoning Ordinance and Municipal Code Performance Standards (noise, dust, and odor). Days and hours of construction shall be limited to Monday through Friday between the hours of 7:00 AM and 5:00 PM. No construction shall occur on Saturdays and Sundays or holidays. 12. The applicant shall install improvements to N. Webster Street including striping and signage from Bodega Avenue to Western Avenue as determined to be appropriate by the City Engineer. Improvements shall be reflected on the improvement plans and approved prior to Fire Marshal approval. Improvements shall be installed prior to issuance of a building permit. 26 MITKING / hg7 Under the power and authority conferred upon this Council by the Charter of said City.
